|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1141 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO ASSESSMENTS ON ANIMALS; AMENDING SECTION 25-2505, IDAHO CODE, TO 3 PROVIDE THAT ALL HORSES, MULES AND ASSES ISSUED AN ANNUAL OR SEASONAL 4 BRAND INSPECTION CERTIFICATE BY THE BRAND BOARD PURSUANT TO SECTION 5 25-1121, IDAHO CODE, OR ALL HORSES, MULES AND ASSES CONFINED FOR SLAUGHTER 6 SHALL ONLY BE SUBJECT TO A ONE DOLLAR PER HEAD ASSESSMENT; AND DECLARING 7 AN EMERGENCY. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 25-2505, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 25-2505. ASSESSMENTS -- COLLECTION. (1) There is hereby levied and 12 imposed upon all horses an assessment of three dollars ($3.00) per head to be 13 paid by the owner. The assessment shall revert to one dollar ($1.00) if the 14 referendum held as provided in section 25-2510(1), Idaho Code, results in a 15 majority vote opposing the three dollar ($3.00) assessment. A reversion to a 16 one dollar ($1.00) assessment shall be effective on the date the director of 17 the department of agriculture announces, as provided in section 25-2510, Idaho 18 Code, that the referendum resulted in a majority vote opposing the three dol- 19 lar ($3.00) assessment. Notwithstanding the foregoing, all horses, mules and 20 asses issued an annual or seasonal brand inspection certificate by the brand 21 board pursuant to section 25-1121, Idaho Code, or all horses, mules and asses 22 confined for slaughter shall only be subject to a one dollar ($1.00) per head 23 assessment. 24 (2) The assessment levied and imposed in this section shall be collected 25 on all brand inspections completed on horses in the state of Idaho. 26 (3) The state brand inspector shall collect the assessment in addition 27 to, at the same time, and in the same manner as the fee charged for state 28 brand inspections. The assessment so collected belongs to and shall be paid to 29 the Idaho horse board, either directly or later by remittance together with a 30 report detailing collection of the assessment. The board shall reimburse the 31 state brand inspector for the reasonable and necessary expenses incurred for 32 such collection, in an amount determined by the board and the inspector. 33 SECTION 2. An emergency existing therefor, which emergency is hereby 34 declared to exist, this act shall be in full force and effect on and after its 35 passage and approval.
STATEMENT OF PURPOSE RS 10819C1 All horses, mules and asses issued an annual or seasonal brand inspection certificate, by the Brand Board, pursuant to Section 25-1121, Idaho Code, which does not require a change of ownership, or all horses, mules and asses going to slaughter, shall only be subject to $1.00 per head assessment. Because of a 96 hour limit on change of ownership certificate, shippers are frequently required again, to get a new certificate, at an additional charge. FISCAL IMPACT None Contact: Name: Sen.
