|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1145 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO TRAUMA CARE; AMENDING TITLE 39, IDAHO CODE, BY THE ADDITION OF A 3 NEW CHAPTER 81, TITLE 39, IDAHO CODE, TO CREATE WITHIN THE DEPARTMENT OF 4 HEALTH AND WELFARE A TRAUMA ADVISORY COMMITTEE, TO PROVIDE DUTIES AND TO 5 REQUIRE A REPORT TO THE LEGISLATURE; AND PROVIDING A SUNSET DATE. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Title 39, Idaho Code, be, and the same is hereby amended 8 by the addition thereto of a NEW CHAPTER, to be known and designated as Chap- 9 ter 81, Title 39, Idaho Code, and to read as follows: 10 CHAPTER 81 11 TRAUMA CARE 12 39-8101. TRAUMA CARE ADVISORY COMMITTEE. (1) There is created within the 13 department of health and welfare a trauma care advisory committee to study and 14 make recommendations for the care and treatment of people with traumatic inju- 15 ries in this state. 16 (2) (a) The committee shall be comprised of legislators, individuals 17 knowledgeable in adult or pediatric trauma care, including physicians, 18 nurses and administrators of both large and small hospitals, and emergency 19 medical services personnel, government officials, consumers and persons 20 affiliated with professional health care associations. 21 (b) Members of the committee shall be appointed by the director in such a 22 manner as to make the committee representation broad and balanced among 23 the health care delivery systems in the state, with no more than three (3) 24 representatives coming from any single delivery system or organization. 25 Members shall not receive compensation for their service on the committee, 26 however they shall be reimbursed for actual and necessary expenses, sub- 27 ject to the limits provided in section 67-2008, Idaho Code. 28 (3) The committee shall: 29 (a) Assess the need for improvements in the care of people with traumatic 30 injuries throughout the state; 31 (b) Review trauma systems implemented in other states and determine, if 32 possible, the impact of such systems on trauma patient outcomes, the cost 33 of such systems and if any of the systems studied could work in Idaho; 34 (c) Perform such preliminary work as necessary in anticipation of the 35 implementation of a trauma registry including assisting the department in 36 determining the data that should be collected, the form upon which the 37 data will be collected and the software and hardware requirements of the 38 state and of individual reporting hospitals; 39 (d) Ascertain, to the degree as possible, the cost to reporting hospitals 40 and to the state to establish and maintain a trauma registry and the 41 availability of private sector funding for such an endeavor; 42 (e) Study and/or address any other issues it deems relevant to the intent 2 1 of this chapter; 2 (f) Submit a report to the legislature containing findings, recommenda- 3 tions and proposed legislation, if appropriate. 4 (4) The department shall: 5 (a) Establish committee procedures and administrative policies consistent 6 with this chapter and department rules; 7 (b) Provide administrative support to the committee; and 8 (c) Promulgate rules, if necessary, for the administration of this chap- 9 ter. 10 39-8102. ADVISORY COMMITTEE REPORT. The advisory committee shall submit a 11 report to the legislature prior to January 1, 2002. The report shall include 12 any recommendations the committee may have, including recommendations to 13 improve trauma care and proposed legislation, if appropriate. The committee 14 shall not submit legislation which contains a categorization of hospitals 15 based on their capability to treat trauma patients, nor shall such legislation 16 require the transfer of a patient against the wishes of the patient, his or 17 her next of kin, or the patient's attending physician. 18 SECTION 2. This act shall be null, void and of no force and effect on and 19 after June 30, 2003.
STATEMENT OF PURPOSE RS 11022 trauma is the leading cause of death among young Idahoans (age 1-44). It also ranks among the top four causes of death in Idaho across all age groups. In the pediatric population, there is no disease that even approximates the morbidity and mortality of traumatic injury. Numerous studies throughout the United States have demonstrated that organized trauma care improves patient outcomes, thus reducing the frequency of preventable death and improving functional status of the patient. This legislation creates a trauma advisoiy committee to assess Idaho s response to trauma and to evaluate possible improvements in trauma care.
