1 AN ACT
2 APPROPRIATING MONEYS TO THE SUPREME COURT FOR FISCAL YEAR 2002; APPROPRIATING
3 MONEYS FROM THE GENERAL FUND TO THE GUARDIAN AD LITEM FUND; EXPRESSING
4 LEGISLATIVE INTENT WITH RESPECT TO CERTAIN EXPENDITURES; AND CAPPING THE
5 AMOUNT ALLOCATED FOR ADMINISTRATIVE OVERHEAD IN THE GUARDIAN AT LITEM PRO-
6 GRAM.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. There is hereby appropriated to the Supreme Court, the follow-
9 ing amounts, to be expended from the listed funds for the period July 1, 2001,
10 through June 30, 2002:

15 Federal Grant Fund 418,800
16 Miscellaneous Revenue Fund 312,500
17 TOTAL $26,541,900
18 SECTION 2. There is hereby appropriated $457,900 from the General Fund to
19 be deposited in the Guardian Ad Litem Fund for the period July 1, 2001,
20 through June 30, 2002.
21 SECTION 3. It is legislative intent that of the amount appropriated in
22 Section 1 of this act, an amount not to exceed $5,000 may be used in accor-
23 dance with rules set by the Supreme Court, to assist in defraying expenses
24 relating to or resulting from the discharge of the Supreme Court Justices'
25 official duties and the official duties of the Supreme Court. Further, it is
26 legislative intent that an amount, not to exceed $1,500 of the amount appro-
27 priated in Section 1 of this act, may be used in accordance with rules set by
28 the Supreme Court to assist in defraying expenses relating to or resulting
29 from the discharge of the Court of Appeals Judges' official duties and the
30 official duties of the Court of Appeals. Such moneys shall be accounted for
31 according to the provisions of Chapter 36, Title 67, Idaho Code, and Section
32 67-3516, Idaho Code.
33 SECTION 4. It is legislative intent that the amount allocated for admin-
34 istrative overhead to the administrative agency selected by the Idaho Supreme
35 Court for the Guardian Ad Litem Program be capped at $30,000 for the period
36 July 1, 2001, through June 30, 2002.

The $24,003,500 General Fund FY2002 Appropriation in column 3 of the Fiscal Note includes the amount appropriated from the General Fund in Section 1 and Section 2 in this appropriation bill to the Guardian Ad Litem Fund.
Enhancements 1,2, and 3. All other budget actions concerning drug courts, services to children in family court, court assistance offices, and judicial pay increases are tied to pending legislative action and will be considered at such time when action is complete. Substance abuse treatment funding to support drug courts is included in the Substance Abuse Initiative Act.
Enhancement 4. Senior Judges for Case Backload provides sufficient funding for 100 more days of service by senior judges.
Enhancement 7. Law for District Judge provides a state-paid law clerk for the Snake River Basin Adjudication Court in Gooding County. Each county in Idaho pays for law clerks to support the district judges. In this instance, a law clerk supports a district judge working on a statewide issue rather than a limited regional issue.
