1 AN ACT
2 APPROPRIATING MONEYS FOR THE OFFICE OF THE STATE BOARD OF EDUCATION FOR FISCAL
3 YEAR 2002; LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; REAPPRO-
4 PRIATING CERTAIN UNEXPENDED AND UNENCUMBERED BALANCES; AND SETTING FORTH
5 CONDITIONS FOR THE REAPPROPRIATION.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. There is hereby appropriated to the State Board of Education
8 for the Office of the State Board of Education the following amounts to be
9 expended according to the designated expense classes from the listed funds for
10 the period July 1, 2001, through June 30, 2002:

26 SECTION 2. In accordance with Section 67-3519, Idaho Code, the agency is
27 authorized no more than twenty-one (21) full-time equivalent positions at any
28 point during the period July 1, 2001, through June 30, 2002, for the program
29 specified in Section 1 of this act, unless specifically authorized by the Gov-
30 ernor. The Joint Finance-Appropriations Committee will be notified promptly of
31 any increased positions so authorized.
32 SECTION 3. There is hereby reappropriated to the State Board of Education
33 for the Office of the State Board of Education the unexpended and unencumbered
34 balance of any appropriation contained in Section 1, Chapter 450, Laws of
35 2000, to be used for nonrecurring expenditures for the period July 1, 2001,
36 through June 30, 2002.
37 SECTION 4. The reappropriation granted in Section 3 of this act shall be
38 subject to the following provisions:
39 (1) If the unexpended and unencumbered balance in the General Fund on
40 June 30, 2001, is zero, the reappropriation for the General Fund in Section 3
41 of this act is hereby declared to be null and void.

1 (2) If the unexpended and unencumbered balance in the General Fund on
2 June 30, 2001, is greater than zero but less than the total General Fund re-
3 appropriation authority granted to all state agencies, the amount reappropri-
4 ated in Section 3 of this act shall be in the proportion that the reappropria-
5 tion for the Office of the State Board of Education bears to the total General
6 Fund reappropriation authority granted to all state agencies.
