$5,935,600 to the State Board of Education and the Board of Regents of the
University of Idaho for Special Programs, including Forest Utilization
Research Program, Idaho Geological Survey Program, Scholarships and Grants
Program, Idaho Museum of Natural History, Idaho Small Business Development
Centers, and the Idaho Council on Economic Education for fiscal year 2002;

1 AN ACT
2 APPROPRIATING MONEYS FOR SPECIAL PROGRAMS FOR FISCAL YEAR 2002; LIMITING THE
3 NUMBER OF FULL-TIME EQUIVALENT POSITIONS; REAPPROPRIATING ANY UNEXPENDED
4 AND UNENCUMBERED GENERAL FUND BALANCES FOR THE DESIGNATED PROGRAMS; AND
5 SETTING FORTH CONDITIONS FOR THE REAPPROPRIATION.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. There is hereby appropriated to the Board of Regents of the
8 University of Idaho and the State Board of Education for Special Programs the
9 following amounts to be expended for the designated programs according to the
10 designated expense classes from the listed funds for the period July 1, 2001,
11 through June 30, 2002:

41 SECTION 2. In accordance with Section 67-3519, Idaho Code, there is
42 hereby authorized no more than twenty-five and seventy-nine hundredths (25.79)

1 full-time equivalent positions at any point during the period July 1, 2001,
2 through June 30, 2002, for the Forest Utilization Research Program, Idaho Geo-
3 logical Survey Program and the Idaho Museum of Natural History as specified in
4 Section 1 of this act, unless specifically authorized by the Governor. The
5 Joint Finance-Appropriations Committee will be notified promptly of any
6 increased positions so authorized.
7 SECTION 3. There is hereby reappropriated to the Board of Regents of the
8 University of Idaho and to the State Board of Education for the Forest Utili-
9 zation Research Program, Idaho Geological Survey Program, Scholarships and
10 Grants Program, Idaho Museum of Natural History, Idaho Small Business Develop-
11 ment Centers, and Idaho Council on Economic Education, the unexpended and
12 unencumbered balance of any General Fund appropriation made to each respective
13 program under Section 1, Chapter 396, Laws of 2000, for each respective pro-
14 gram to be used for nonrecurring expenditures for the period July 1, 2001,
15 through June 30, 2002.
16 SECTION 4. The reappropriation granted in Section 3 of this act shall be
17 subject to the following conditions:
18 (1) If the unexpended and unencumbered balance in the General Fund on
19 June 30, 2001, is zero, the reappropriation in Section 3 is declared to be
20 null and void.
21 (2) If the unexpended and unencumbered balance in the General Fund on
22 June 30, 2001, is greater than zero but less than the total reappropriation
23 authority granted to all state agencies, the amounts reappropriated in Section
24 3 shall be in the proportion that the reappropriation for each respective pro-
25 gram bears to the total General Fund reappropriation authority granted to all
26 state agencies.

This is the FY 2002 appropriation for the Special Programs under the State Board of Education. The six Special Programs are: the Forest Utilization Research Program and the Idaho Geological Survey at the University of Idaho; the Scholarships & Grants Program administered by the Office of the State Board of Education; the Idaho Museum of Natural History at Idaho State University; the Idaho Small Business Development Centers and the Idaho Council for Economic Education at Boise State University.
