1 AN ACT
2 APPROPRIATING MONEYS TO THE SECRETARY OF STATE FOR FISCAL YEAR 2002; EXPRESS-
3 ING LEGISLATIVE INTENT WITH RESPECT TO CERTAIN EXPENDITURES; REAPPROPRIA-
4 TING CERTAIN UNEXPENDED AND UNENCUMBERED BALANCES; SETTING CONDITIONS FOR
5 THE REAPPROPRIATION; AND LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSI-
6 TIONS.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. There is hereby appropriated to the Secretary of State, the
9 following amounts to be expended for the designated programs according to the
10 designated expense classes from the listed funds for the period July 1, 2001,
11 through June 30, 2002:

26 SECTION 2. It is legislative intent that an amount not to exceed $1,000
27 of the amount appropriated in Section 1 of this act, may be used at the dis-
28 cretion of the Secretary of State to assist in defraying expenses relating to
29 or resulting from the discharge of the Secretary of State's official duties.
30 Such moneys shall be accounted for according to the provisions of Chapter 36,
31 Title 67, Idaho Code, and Section 67-3516, Idaho Code.
32 SECTION 3. There is hereby reappropriated to the Secretary of State, any
33 unexpended and unencumbered cash balance of any appropriation made to the Sec-
34 retary of State for fiscal year 2001, to be used for nonrecurring expenditures
35 only for the period July 1, 2001, through June 30, 2002.
36 SECTION 4. The reappropriation granted in Section 3 of this act is sub-
37 ject to the following provisions:
38 If the unexpended and unencumbered balance in the General Fund on June 30,
39 2001, is zero, the reappropriation of General Fund money in Section 3 of this
40 act is hereby declared to be null and void.

1 If the unexpended and unencumbered balance in the General Fund on June 30,
2 2001, is greater than zero but less than the total General Fund reappropria-
3 tion authority granted to all state agencies, the amount of General Fund money
4 reappropriated in Section 3 of this act shall be in the proportion that the
5 General Fund reappropriation for the Secretary of State bears to the total
6 General Fund reappropriation authority granted to all state agencies.
7 SECTION 5. In accordance with Section 67-3519, Idaho Code, the Office of
8 the Secretary of State is authorized no more than thirty-two (32) full-time
9 equivalent positions at any point during the period July 1, 2001, through June
10 30, 2002, for the programs specified in Section 1 of this act, unless specifi-
11 cally authorized by the Governor. The Joint Finance-Appropriations Committee
12 will be notified promptly of any increased positions so authorized.
