1 AN ACT
2 APPROPRIATING MONEYS FROM THE IDAHO MILLENNIUM INCOME FUND TO THE STATE TREA-
3 SURER FOR THE PURPOSES SPECIFIED FOR FISCAL YEAR 2002; APPROPRIATING
4 MONEYS TO VARIOUS PROGRAMS; PROVIDING LEGISLATIVE INTENT TO THE CATA-
5 STROPHIC HEALTH CARE COST PROGRAM BOARD REGARDING CERTAIN EXPENDITURES;
6 AND PROVIDING LEGISLATIVE INTENT REGARDING THE ALLOCATION OF AVAILABLE
7 FUNDS.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. There is hereby appropriated from the Idaho Millennium Income
10 Fund to the State Treasurer $2,756,500 to be expended for trustee and benefit
11 payments as specified in Section 2 of this act for the period July 1, 2001,
12 through June 30, 2002.
13 SECTION 2. Of the amount appropriated to the State Treasurer for trustee
14 and benefit payments in Section 1 of this act, there is hereby appropriated
15 from the Idaho Millennium Income Fund to the following programs for the period
16 July 1, 2001, through June 30, 2002:
17 (a) $506,500 for the Public Health Districts to continue tobacco use ces-
18 sation programs statewide through the Public Health Districts of Idaho and
19 other nonprofit entities such as hospitals, primary care clinics and vol-
20 unteer organizations. The tobacco use cessation programs should be avail-
21 able to any Idaho citizen, with primary emphasis on youth and pregnant
22 women. The program shall include strong evaluation measures including, but
23 not limited to, the number of programs funded, the number of participants
24 and quit rates.
25 (b) $735,000 for the Catastrophic Health Care Cost Program for tobacco-
26 related disease treatment as determined by a physician, by way of reducing
27 the county deductible payment pursuant to Section 3 of this act.
28 (c) $500,000 for the Bureau of Health Promotion in the Department of
29 Health and Welfare for targeted tobacco counter-marketing programs, spe-
30 cific to Idaho, and to be matched by private industry funds on at least a
31 one-to-one basis.
32 (d) $170,000 for the Idaho Supreme Court for youth courts and community-
33 based programs in the judicial districts that address tobacco and/or sub-
34 stance abuse. Of the amount specified, $50,000 will be used for the Buhl
35 School District Substance Abuse Pilot Program.
36 (e) $200,000 for the Children's Trust Account Board in the Department of
37 Health and Welfare to expand youth-asset building activities to more Idaho
38 communities.

1 (f) $150,000 for the Idaho Supreme Court to expand the status offender
2 pilot program into other judicial districts to identify high-risk youth
3 and provide services and monitoring aimed at stopping and deescalating the
4 cycle toward incarceration.
5 (g) $400,000 for the Public Health Services Division within the Depart-
6 ment of Health and Welfare for coordinating efforts to reduce adolescent
7 pregnancy through a media campaign to raise awareness of the human and
8 societal risks associated with adolescent pregnancy.
9 (h) $95,000 for the Center for Health Policy at Boise State University
10 for surveillance and evaluation. This will be a cooperative effort among
11 Boise State University, Idaho State University, and the University of
12 Idaho whereby the universities would begin evaluating the continuum of
13 substance abuse programs in Idaho. The Center for Health Policy should
14 collaborate with the Department of Health and Welfare and to the extent
15 possible utilize the baseline data being developed by the Bureau of Health
16 Promotion so as to avoid duplication in efforts.
17 GRAND TOTAL: $2,756,500
18 SECTION 3. It is legislative intent that the Catastrophic Health Care
19 Cost Program Board use the funds appropriated in Section 2(b) of this act to
20 temporarily reduce the $10,000 deductible paid by counties for the costs of
21 caring for indigent persons with tobacco-related diseases. The Catastrophic
22 Health Care Cost Program Board shall be vested with the authority to define
23 and determine which cases qualify for the reduced county deductible, subject
24 to the provisions of this section. Notwithstanding the provisions of Chapter
25 35, Title 31, Idaho Code, the Catastrophic Health Care Cost Program Board is
26 hereby granted the authority to enact these reductions for the period July 1,
27 2001, through June 30, 2002, provided that the additional fiscal impact of
28 these reductions on the Catastrophic Health Care Cost Program shall not exceed
29 the amount appropriated in Section 2(b) of this act.
30 SECTION 4. It is legislative intent that if the total amount of moneys
31 appropriated in Section 2 of this act is not available for appropriation, then
32 the State Treasurer shall allocate such funds as are available to the recipi-
33 ents listed in Section 2 of this act, in the proportion that the amount each
34 recipient's appropriation bears to the total amount appropriated.

This appropriation funds eight projects totaling $2,756,500 in one-time dedicated funds.
Section 3 grants the Catastrophic Health Care Cost Program Board the authority necessary to implement the $735,000 cost reduction for county indigent health care costs. Section 4 provides a mechanism for allocating the distribution of Millennium Fund earnings.
