  1                                        AN ACT
  2    RELATING TO THE BOARD OF DENTISTRY; AMENDING SECTION 54-907,  IDAHO  CODE,  TO
  3        STRIKE OBSOLETE LANGUAGE AND TO FURTHER GOVERN THE TERM OF OFFICE.
                                                                        
  4    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  5        SECTION  1.  That  Section  54-907, Idaho Code, be, and the same is hereby
  6    amended to read as follows:
                                                                        
  7        54-907.  STATE BOARD OF DENTISTRY ESTABLISHED. There is hereby established
  8    in the department of self-governing agencies a state board of dentistry to  be
  9    composed  of eight (8) members, five (5) of whom shall be dentists, two (2) of
 10    whom shall be dental hygienists, and one (1) of whom shall be a consumer  per-
 11    son  familiar  with  health care occupations. The dentist members of the board
 12    holding such position on July 1, l981, shall remain in office  as  members  of
 13    the  board  of  dentistry until their respective terms as members of the board
 14    shall have expired, and thereafter dentist members of the board  of  dentistry
 15    shall  be  appointed  by  the  governor  in  the manner set forth herein. Upon
 16    appointment by the governor, the term of office of a  dentist  member  of  the
 17    board shall commence on the first Monday of February following his appointment
 18    and  shall continue for five (5) years, or until his successor has been named,
 19    whichever is later. A vacancy in membership of the board shall occur  whenever
 20    the  regular  term  of  a  member expires or when a member dies, resigns or is
 21    removed from office by the governor. Appointments to fill a vacancy  occurring
 22    for  some reason other than expiration of term of office shall be made for the
 23    unexpired term which is being filled. The governor may remove  any  member  of
 24    the board from membership on the board who is found by the governor to be men-
 25    tally  or  physically  incapable of acting, or to be neglecting or refusing to
 26    act, or who ceases to have the qualifications of a member or who has failed to
 27    attend, without reasonable cause, two (2) successive meetings of the board.
 28        The dental hygienists and consumer member of the board shall be  appointed
 29    by  the  governor in the manner provided in section 54-908, Idaho Code. Except
 30    as provided herein, the term of office of the dental hygienists  and  consumer
 31    member holding such position on July 1, 1991, and regularly appointed thereaf-
 32    ter,  shall  be five (5) years commencing on the first Monday of February fol-
 33    lowing appointment.

code that extends a board member's term until a replacement is 
appointed.
