SPEAKER Requested by: Division of Building Safety 1 AN ACT 2 RELATING TO ELECTRICAL CONTRACTORS AND JOURNEYMEN; AMENDING SECTION 54-1008, 3 IDAHO CODE, TO REVISE THE LICENSING PERIODS FOR SPECIFIED LICENSES; AMEND- 4 ING SECTION 54-1013, IDAHO CODE, TO PROVIDE THAT LICENSES MAY BE RENEWED 5 DURING THE FINAL MONTH OF THE LICENSING PERIOD; AMENDING CHAPTER 10, TITLE 6 54, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 54-1013A, IDAHO CODE, TO 7 PROVIDE FOR THE RENEWAL OF SPECIFIC LICENSES ISSUED PRIOR TO JULY 1, 2002; 8 AND AMENDING SECTION 54-1014, IDAHO CODE, TO REVISE FEES CHARGED FOR 9 LICENSES AND LICENSE APPLICATIONS, RENEWALS AND REVIVALS AND TO PROVIDE 10 THAT FEES FOR CERTAIN LICENSES SHALL BE PRORATED. 11 Be It Enacted by the Legislature of the State of Idaho: 12 SECTION 1. That Section 54-1008, Idaho Code, be, and the same is hereby 13 amended to read as follows: 14 54-1008. DURATION OF LICENSE. All licenses, including license renewals 15 other than as provided in section 54-1013A, Idaho Code, for master electri- 16 cians, journeyman electricians and specialty journeyman electricians shall 17 bear the date of issue, and shall expireon the first day of July next follow-18ingthirty-six (36) calendar months from the date of issue, unless renewed as 19 provided inthis actsection 54-1013, Idaho Code. Electrical contractor, spe- 20 cialty electrical contractor and apprentice/specialty trainee licenses issued 21 after July 1, 2002, shall bear the date of issue and shall expire on the first 22 day of July next following the date of issue, unless renewed as provided in 23 section 54-1013, Idaho Code. Each licensing period shall end at midnight on 24 the last day of the licensing period. 25 SECTION 2. That Section 54-1013, Idaho Code, be, and the same is hereby 26 amended to read as follows: 27 54-1013. RENEWAL OF LICENSES. A license once issued under this act, 28 unless revoked or suspended as herein provided, may be renewed at any time 29 during the final month ofJuly next following its issuancethe licensing 30 period on the payment of the renewal fee herein specified, proof of satisfac- 31 tion of the continuing education requirements as established by the electrical 32 board, and provided that all outstanding civil penalties, and permit or other 33 fees, have been paid in full, and all outstanding correction notices have been 34 satisfactorily resolved. Any license which has expired may be revived at any 35 time within one (1) year from the first day ofJuly next following its issu-36ancethe final month of the licensing period, by payment of the revival fee 37 herein specified, together with all outstanding civil penalties, and permit or 38 other fees and penalties, and upon proof that outstanding correction notices 39 have been satisfactorily resolved. Certificates of competency issued prior to 40 July 1, 1961, shall, for the purpose of this act, be considered as licenses 41 and may be renewed or revived as herein provided. 2 1 SECTION 3. That Chapter 10, Title 54, Idaho Code, be, and the same is 2 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 3 ignated as Section 54-1013A, Idaho Code, and to read as follows: 4 54-1013A. RENEWAL OF CERTAIN LICENSES ISSUED PRIOR TO JULY 1, 2002. (1) 5 The following licensing periods shall apply to master electrician, journeyman 6 electrician and specialty journeyman electrician licenses issued prior to July 7 1, 2002: 8 (a) One-third (1/3) of such licenses, as determined alphabetically by the 9 administrator, shall expire one (1) year after the date of issue; 10 (b) One-third (1/3) of such licenses, as determined alphabetically by the 11 administrator, shall expire two (2) years after the date of issue; and 12 (c) One-third (1/3) of such licenses, as determined alphabetically by the 13 administrator, shall expire three (3) years after the date of issue. 14 (2) Each subsequent renewal of a master electrician, journeyman electri- 15 cian or specialty journeyman electrician license issued prior to July 1, 2002, 16 shall be for a period of three (3) years, provided all requirements for 17 renewal as set forth in section 54-1013, Idaho Code, have been met. 18 SECTION 4. That Section 54-1014, Idaho Code, be, and the same is hereby 19 amended to read as follows: 20 54-1014. FEES. STATEMENT OF PURPOSE RS 11484 The Division of Building Safety, Electrical Bureau, renews licenses for master, journeyman and specialty electricians on an annual basis. (July of each year). The Electrical Bureau proposes to increase the duration of licenses to three years rather than each year, and stagger the renewals based on the original issue date. This would be more convenient for the licensee. By staggering the license renewals every three years, the bureau could provide a timelier processing of the renewals and a more even distribution of workload and service. FISCAL IMPACT The Electrical Bureau operates from dedicated funds. The funds are generated from electrical licenses and electrical safety inspections (permits). The three- year licensing fee will be based on the present yearly fees so there is no increase in fees. License renewal fees for more than one fiscal year would be received initially. After the implementation period, 1/3 of the three-year license fees would be received annually. The Electrical Bureau proposes to implement this renewal process over a three-year period.
