BOUNDARY LINES - Amends existing law relating to surveys of boundary lines
to provide that the services of a professional land surveyor may be
procured to establish boundaries when doubts arise about the location of a

  1                                        AN ACT
  2    RELATING TO SURVEYS OF BOUNDARY LINES; AMENDING SECTION 35-110, IDAHO CODE, TO
  3        PROVIDE CORRECT TERMINOLOGY.
                                                                        
  4    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  5        SECTION 1.  That Section 35-110, Idaho Code, be, and the  same  is  hereby
  6    amended to read as follows:
                                                                        
  7        35-110.  SURVEY  OF  LINE. The person building such fence, or the occupant
  8    or owner of the land whereon the same is built, may, upon notice to the  other
  9    party,  whenever  doubts  arise  about the location of such fence, procure the
 10    services of a registered professional land surveyor or engineer to run  estab-
 11    lish  the  division boundary line between their respective lands, and the line
 12    so run established is sufficient notice to the party making the mistake, so as
 13    to require him to remove such fence within one (1) year thereafter.

			STATEMENT OF PURPOSE
		              RS 11443

The purpose of this amendment is to eliminate an obsolete reference to
engineers who, since 1978, have not been licensed to practice land 
surveying and also to replace obsolete terminology with more current 
terminology.
                             FISCAL IMPACT

There is no fiscal impact to either the General Fund or the Dedicated 
Funds of the Board.
