SPEAKER Requested by: Division of Veterans Services 1 AN ACT 2 RELATING TO VETERANS SERVICES AND AFFAIRS; AMENDING SECTION 65-202, IDAHO 3 CODE, TO PROVIDE THAT CERTAIN ADMINISTRATORS SHALL BE CONSIDERED NONCLAS- 4 SIFIED EXEMPT EMPLOYEES OF THE STATE OF IDAHO AND SHALL SERVE AT THE 5 PLEASURE OF THE ADMINISTRATOR OF THE DIVISION OF VETERANS SERVICES. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 65-202, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 65-202. POWERS AND DUTIES. The administrator of the division of veterans 10 services shall have full power and authority on behalf of the state of Idaho, 11 in recognition of the services rendered by veterans of the armed forces of the 12 United States, to oversee the management and operation of the veterans homes 13 in the state and the state veterans cemetery, and provide such care to vet- 14 erans of the armed forces of the United States. Further, the administrator 15 shall extend financial relief and assistance to disabled or destitute wartime 16 veterans and to those dependent upon such disabled or destitute wartime vet- 17 erans as the commission shall determine to be reasonably required under such 18 rules as the administrator may, from time to time, adopt. The administrator is 19 further authorized to collect benefits paid by the United States department of 20 veterans affairs for burial and plot allowance for persons interred at the 21 state veterans cemetery and directed to cause such benefits to be deposited in 22 the veterans cemetery maintenance fund established in section 65-107, Idaho 23 Code. 24 With the approval of the commission, the administrator may prescribe the 25 qualifications of all personnel on a nonpartisan merit basis in accordance 26 with the Idaho personnel system law for employment of personnel in the divi- 27 sion of veterans services. The administrators in charge of state veterans 28 homes and the office of veterans advocacy shall be considered nonclassified 29 exempt employees pursuant to the provisions of chapter 53, title 67, Idaho 30 Code, and shall serve at the pleasure of the administrator of the division of 31 veterans services.
REPRINT REPRINT REPRINT REPRINT REPRINT STATEMENT OF PURPOSE RS 11472 The purpose of this proposed legislation is to amend Idaho Code 65- 202 making Veterans Home administrators and Office of Veterans Advocacy program supervisors exempt employees. During the 2000 legislative session when the Division of Veterans Services became a Self-Governing Agency, language was omitted from the bill, which resulted in a reclassification of the State Veterans Home administrators from exempt to classified employees. This proposed legislation would return them to their former status as exempt employees who serve at the will of the Division Administrator and change the Office of Veterans Advocacy program supervisor to an exempt position as well. FISCAL IMPACT Cost savings in overtime hours may be realized by changing the Office of Veterans Advocacy program supervisor from a classified to an exempt position.
