IDAHO CODE FUND - Amends existing law to provide that at the beginning of
each fiscal year those moneys in the Idaho Code Fund that exceed the prior
year's expenditures, excluding a transfer by appropriation, by twenty-five
percent or more shall be transferred to the General Fund; and to

  1                                        AN ACT
  2    RELATING TO THE IDAHO CODE FUND; AMENDING SECTION 73-215, IDAHO CODE, TO  PRO-
  3        VIDE  THAT  AT THE BEGINNING OF EACH FISCAL YEAR THOSE MONEYS IN THE IDAHO
  4        CODE FUND THAT EXCEED THE PRIOR YEAR'S EXPENDITURES, EXCLUDING A  TRANSFER
  5        BY  APPROPRIATION,  BY TWENTY-FIVE PERCENT OR MORE SHALL BE TRANSFERRED TO
  6        THE GENERAL FUND AND TO MAKE A TECHNICAL CORRECTION; APPROPRIATING  MONEYS
  7        FROM  THE  IDAHO  CODE  FUND FOR DEPOSIT IN THE GENERAL FUND; DECLARING AN
  8        EMERGENCY AND PROVIDING  EFFECTIVE DATES.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION 1.  That Section 73-215, Idaho Code, be, and the  same  is  hereby
 11    amended to read as follows:
                                                                        
 12        73-215.  CODE  FUND  CREATED.  There is hereby created in the hands of the
 13    state treasurer a fund to be known as the "Code Fund." All funds in the  hands
 14    of  the  state  treasurer  credited  to the "1947 "Idaho Code Fund" are hereby
 15    transferred, appropriated to and made a part of the code fund,  together  with
 16    any  and  all  moneys  now  or hereafter remitted to and received by the state
 17    treasurer for deposit in the code fund pursuant to section 73-213, Idaho Code.
 18    of this act At the beginning of each fiscal year those  moneys  in  the  Idaho
 19    code  fund  that exceed the prior year's expenditures, excluding a transfer by
 20    appropriation, by twenty-five percent (25%) or more shall  be  transferred  to
 21    the general fund.
                                                                        
 22        SECTION  2.  There  is  hereby  appropriated  from the Idaho Code Fund for
 23    deposit in the General Fund the amount of $1,300,000.
                                                                        
 24        SECTION 3.  An emergency existing  therefor,  which  emergency  is  hereby
 25    declared  to exist, Section 2 of this act shall be in full force and effect on
 26    and after its passage and approval. Section 1 of this act  shall  be  in  full
 27    force and effect on and after July 1, 2002.

Statement of Purpose / Fiscal Impact


                           STATEMENT OF PURPOSE

                                RS 11553

This legislation was recommended by our legislative auditors. At the 
beginning of each fiscal year those moneys in the Idaho code fund 
that exceed the prior years’ expenditures, excluding a transfer by 
appropriation, by twenty-five percent (25%) or more shall be 
transferred to the general fund. There is hereby appropriated from 
the Idaho Code Fund for deposit in the General Fund the amount of 
$1,300,000.


                             FISCAL IMPACT



This bill has a positive $1.3 million dollar impact on the 2002 
general fund. The positive impact to the general fund in future years 
is uncertain but should average around $100,000 annually.
