  1                                        AN ACT
  2    RELATING TO CONDUCT OF SCHOOL  TRUSTEE  ELECTIONS;  AMENDING  SECTION  33-503,
  3        IDAHO  CODE,  TO  PROVIDE  THAT SCHOOL TRUSTEE ELECTIONS SHALL BE HELD THE
  4        FOURTH TUESDAY IN MAY AND TO MAKE A TECHNICAL CORRECTION.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 33-503, Idaho Code, be, and the  same  is  hereby
  7    amended to read as follows:
                                                                        
  8        33-503.  ELECTION OF TRUSTEES -- UNIFORM DATE. The election of school dis-
  9    trict  trustees  including  those  in  charter districts shall be on the third
 10    fourth Tuesday in May. Notice and conduct of the election, and the  canvassing
 11    of the returns shall be as provided in sections 33-401-- through 33-406, Idaho
 12    Code.  In each trustee zone, the person receiving the greatest number of votes
 13    cast within his the zone shall be declared by the board  of  trustees  as  the
 14    trustee elected from that zone.
 15        If  any  two  (2)  or  more  persons  have an equal number of votes in any
 16    trustee zone and a greater number than any other nominee  in  that  zone,  the
 17    board of trustees shall determine the winner by a toss of a coin.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE
                            RS 11623

It is critical that public confidence in the election process 
be maintained at the highest level.  Under current law the 
election of school board trustees is held one week before the 
May primary election date.  Voters are often confused and do 
not realize the election of school trustees occurs one week 
before the nomination/election of all other candidates.  This 
legislation will enable the maximum number of citizens to 
participate in trustee elections by eliminating the current 
requirement to make a separate trip to the polls on a separate 
date.

                         FISCAL IMPACT

There will be no fiscal impact on the general fund of the state.  
Some savings may be realized on the local level by eliminating the 
need to conduct a separate election.
