  1                                        AN ACT
  2    RELATING TO THE DEPARTMENT OF AGRICULTURE; AMENDING CHAPTER 1, TITLE 22, IDAHO
  3        CODE, BY THE ADDITION OF A NEW  SECTION  22-111,  IDAHO  CODE,  TO  CREATE
  4        WITHIN  THE  DEPARTMENT  OF  AGRICULTURE THE OFFICE OF THE PRESERVATION OF
  5        AGRICULTURAL LANDS, TO ESTABLISH THE AGRICULTURAL LAND PRESERVATION  GRANT
  6        FUND AND TO SET FORTH PURPOSES FOR FUND MONEYS.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Chapter  1,  Title  22, Idaho Code, be, and the same is
  9    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 10    ignated as Section 22-111, Idaho Code, and to read as follows:
                                                                        
 11        22-111.  OFFICE  OF  THE  PRESERVATION  OF AGRICULTURAL LANDS -- FUND. (1)
 12    There is hereby created and established within the department  of  agriculture
 13    the  office of the preservation of agricultural lands, hereinafter referred to
 14    as PAL, which may:
 15        (a)  Educate state agencies and local governments  on  the  importance  of
 16        agricultural  land preservation and on the significance of agriculture and
 17        agribusiness to this state's economy;
 18        (b)  Serve as a liaison with other agricultural land preservation entities
 19        operating on a state, regional or national level;
 20        (c)  Prepare an inventory of agricultural lands within  Idaho  to  monitor
 21        the  development  of  lands within this state having prime soils or unique
 22        microclimates;
 23        (d)  Prepare guidelines and criteria for use in the development  of  agri-
 24        cultural land preservation action plans;
 25        (e)  Establish an agricultural land preservation program to coordinate and
 26        assist local agricultural land preservation initiatives; and
 27        (f)  Administer  the agricultural land preservation grant fund established
 28        in subsection (2) of this section to provide grants to counties developing
 29        agricultural land preservation action plans.
 30        (2)  There is hereby created and established in the state treasury a  fund
 31    to be known as the "agricultural land preservation grant fund," which may con-
 32    sist of such funds as may be appropriated for that purpose by the legislature,
 33    grants, donations or moneys from other sources. The fund shall be administered
 34    by  PAL within the department of agriculture and may be used for the following
 35    purposes:
 36        (a)  To provide moneys to counties for one (1) year grants, not  exceeding
 37        ten  thousand  dollars ($10,000) per grant, for the preparation and imple-
 38        mentation of agricultural land preservation action plans; and
 39        (b)  To hire such employees as may be necessary for purposes  of  carrying
 40        out the provisions of this section.

  2        On page 1 of the printed bill, in  line  24,  following  "plans;"  insert:
  3    "and"; in line 26, delete "; and" and insert: "."; delete lines 27 through 29;
  4    in  line  31, delete "grant"; in line 34, delete "and may be used for the fol-
  5    lowing"; delete lines 35 through 38; and in  line  39,  delete  "(b)  To"  and
  6    insert:  "in  order  to  carry out the purposes set forth in subsection (1) of

  8                                 CORRECTION TO TITLE
  9        On page 1, in line 5, delete "GRANT".

Statement of Purpose / Fiscal Impact


                	STATEMENT OF PURPOSE
                             RS 11514


The purpose of this legislation is to create an office of the 
preservation of agricultural lands (PAL) within the department 
of agriculture. This office would monitor and prepare guidelines 
for the development of agricultural land in the state as well as 
educate and coordinate with local, state, and national government 
agencies on the issue of preservation. This legislation also 
creates an “agricultural land preservation grant fund” in the 
state to provide grants of up to $10,000 to counties for 
preservation of agricultural lands.

                         FISCAL IMPACT

There is no fiscal impact to the general fund. Funding will come 
from foundation grants and federal agency programs.
