|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 549 BY REVENUE AND TAXATION COMMITTEE 1 AN ACT 2 RELATING TO TAX INFORMATION; AMENDING CHAPTER 30, TITLE 63, IDAHO CODE, BY THE 3 ADDITION OF A NEW SECTION 63-3077C, IDAHO CODE, TO PROVIDE FOR AGREEMENT 4 FOR EXCHANGE OF INFORMATION BETWEEN THE TAX COMMISSION AND THE DEPARTMENT 5 OF FISH AND GAME AND SPECIFYING THE INFORMATION WHICH MAY BE PROVIDED BY 6 THE TAX COMMISSION. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 30, Title 63, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 10 ignated as Section 63-3077C, Idaho Code, and to read as follows: 11 63-3077C. AGREEMENT FOR EXCHANGE OF INFORMATION WITH DEPARTMENT OF FISH 12 AND GAME. The state tax commission and the department of fish and game may 13 enter into a written agreement for exchange of information relating to an 14 individual's place of residence or domicile. Such information shall be confi- 15 dential to the recipient and may be used by the department of fish and game 16 only for purposes of determining whether a person who has purchased a resident 17 fish and game license and to whom the information relates is entitled to pur- 18 chase a resident fish and game license, or by the state tax commission for 19 determining if the individual is complying with laws relating to taxation. No 20 such information shall be public information unless it is used in the course 21 of a judicial proceeding arising under the laws of this state. The information 22 provided by the state tax commission shall be limited to the following: 23 (1) Identification of an individual. 24 (2) An individual's home address. 25 (3) An individual's residency status.
STATEMENT OF PURPOSE RS 11580 This bill will authorize the Idaho Department of Fish and Game to exchange specific information under a written agreement with the Idaho State Tax Commission pertinent to determining residency status. The information which may be exchanged is confidential and limited to identification, home address, and residency status. The ability of the Department of Fish and Game to acquire this information from the Tax Commission will allow Conservation Officers to more efficiently and accurately identify nonresidents who fraudulently purchase resident fish and game licenses thereby defrauding the state of needed revenue and decreasing opportunities for Idaho residents.
