That Section 36-306, Idaho Code, be, and the same is hereby 29 amended to read as follows: 30 36-306. VENDOR FEE. All persons authorized to issue licenses shall charge 31 a vendor issuance fee of one dollar and fifty cents ($1.50) upon all licenses 32 issued, not less than one-half (1/2) to be retained by them as compensation 33 for the issuance of such licenses as may be specified by contract between the 34 license vendor and the department for license issuance services performed by 35 the vendor; provided that the vendor fee for an eighth class license as that 36 license is provided for in section 36-406(f), Idaho Code, shall be equal to 37 one-half (1/2) the total vendor fee had each license, tag, permit or stamp 38 been separately issued; provided further, the director may waive the vendor 39 issuance fee for a license not issued by the department's computerized licens- 40 ing system. The amount of the vendor fee retained by the department shall be 41 deposited in the fish and game account and shall be used to help offset the 42 cost of the computerized licensing system. Such vendor fee shall be charged in 43 addition to the regular cost of the license. However, in the case of crayfish 2 1 or minnow traps, beaver, bobcat or lynx tags the vendor fee shall be charged 2 for each issuance of tags for each species regardless of the number of tags 3 issued in said transaction. Proceeds from department issued licenses may be 4 set aside for the department's special operations program, including citizens 5 against poaching. 6 SECTION 2. That Section 36-404, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 36-404. CLASSES OF LICENSES. The licenses required by the provisions of 9 this title shall be of eight (8) classes.Licenses of the first five (5)10cClassesmentionedone (1) through five (5) and eight (8) in this section may 11 be purchased or obtained only by persons who meet residency requirements under 12 the provisions of section 36-202(s) and (t), Idaho Code, or who are valid 13 holders of a lifetime license certificate. 14 Class 1: Adult Combination -- Hunting -- Fishing -- Trapping Licenses. 15 Licenses to be issued only to persons who are residents of the state of Idaho. 16 Class 2:YouthJunior Hunting -- Trapping -- Youth Small Game Licenses. 17 (a) Junior hHunting license. Licenses to be issued only to persons who 18 are residents of the state of Idaho and are between twelve (12) and seventeen 19 (17) years of age, inclusive. Provided, that a license may be issued to qual- 20 ified persons who are eleven (11) years of age to allow the application for a 21 controlled hunt permit; however, said persons shall not hunt until they are 22 twelve (12) years of age. 23 (b) Junior tTrapping licenses. Licenses to be issued only to persons who 24 are residents of the state of Idaho and are seventeen (17) years of age or 25 younger. 26 (c) Youth small game licenses. Licenses to be issued only to qualified 27 persons who are residents of the state of Idaho and are ten (10) or eleven 28 (11) years of age to hunt upland game birds (including turkeys), migratory 29 game birds, cottontail rabbits, pygmy rabbits, and unprotected and predatory 30 birds and animals of this state while accompanied in the field by an adult 31 licensed to hunt in the state of Idaho. 32 Class 3:YouthJunior Combination -- Fishing Licenses. Licenses to be 33 issued only to persons who are residents of the state of Idaho between four- 34 teen (14) and seventeen (17) years of age, inclusive. 35 Class 4: Senior Resident Combination License. Licenses to be issued only 36 to persons over sixty-five (65) years of age who have been bona fide residents 37 of the state of Idaho for a continuous period of not less than five (5) years 38 last preceding application. 39 Class 5: Resident Lifetime Combination -- Hunting -- Fishing License. 40 Licenses to be issued only to persons who are valid holders of a lifetime 41 license certificate. 42 Class 6: Nonresident Combination -- Hunting -- Fishing -- Trapping -- Jun- 43 ior Mentored Hunting -- Youth Small Game -- Youth Hunter Education Graduate -- 44 Licenses. Licenses required of persons who are nonresidents. 45 Class 7: Duplicate License -- Tag. A license or tag to be issued as a 46 replacement for an original license or tag lost or mutilated. Said license or 47 tag shall be issued in the same class and type as the original and upon issu- 48 ance of such duplicate license or tag the original license or tag shall become 49 null and void. 50 Class 8: Resident Hunting and Fishing License with Tags, Permits and 51 Stamps. Licenses to be issued only to persons who meet residency requirements 52 under the provisions of section 36-202(s) and (t), Idaho Code. 3 1 SECTION 3. That Section 36-406, Idaho Code, be, and the same is hereby 2 amended to read as follows: 3 36-406. RESIDENT FISHING, HUNTING AND TRAPPING LICENSES -- FEES. (a) 4 Adult Licenses -- Combination -- Fishing -- Hunting -- Trapping. A license of 5 the first class may be had by a person possessing the qualifications therein 6 described on payment of a fee as specified in section 36-416, Idaho Code, for 7 a combined fishing and hunting license entitling the purchaser to hunt and 8 fish for game animals, game birds, unprotected and predatory animals and fish 9 of the state, a fee as specified in section 36-416, Idaho Code, for a fishing 10 license entitling the purchaser to fish in the public waters of the state, a 11 fee as specified in section 36-416, Idaho Code, for a hunting license enti- 12 tling the purchaser to hunt game animals, game birds, unprotected and preda- 13 tory animals of the state, and a fee as specified in section 36-416, Idaho 14 Code, for a trapping license entitling the purchaser to trap furbearers, 15 unprotected and predatory animals of the state. 16 (b)YouthJunior Licenses -- Hunting -- Trapping. A license of the second 17 class may be had by a person possessing the qualifications therein described 18 on payment of a fee as specified in section 36-416, Idaho Code, for a hunting 19 license, and a fee as specified in section 36-416, Idaho Code, for a trapping 20 license entitling the purchaser to the same privileges as the corresponding 21 license of the first class provides. 22 (c)YouthJunior Combination -- Fishing Licenses. A license of the third 23 class may be purchased by a person possessing the qualifications therein 24 described on payment of a fee as specified in section 36-416, Idaho Code, for 25 a combined fishing and hunting license, and a fee as specified in section 26 36-416, Idaho Code, for a fishing license entitling the purchaser to the same 27 privileges as the corresponding license of the first class provides. 28 (d) Senior Resident Combination. A license of the fourth class may be had 29 by a person possessing the qualifications therein described on payment of a 30 fee as specified in section 36-416, Idaho Code, for a combined fishing and 31 hunting license entitling the purchaser to the same privileges as the corre- 32 sponding license of the first class provides. 33 (e) Lifetime Licenses -- Combination -- Hunting -- Fishing. A license of 34 the fifth class may be obtained at no additional charge by a person possessing 35 the qualifications therein described for a combined hunting and fishing 36 license, for a hunting license, or for a fishing license, entitling the person 37 to the same privileges as the corresponding license of the first class pro- 38 vides. Lifetime licensees must be certified under the provisions of section 39 36-411, Idaho Code, before being issued a license to hunt. 40 (f) A license of the eighth class may be had by a person possessing the 41 qualifications therein described on payment of a fee as specified in section 42 36-416, Idaho Code, entitling the purchaser to hunt and fish for game animals, 43 game birds, fish, and unprotected and predatory animals of the state. With 44 payment of the required fee, a person shall receive with this license a deer 45 tag, an elk tag, a bear tag, a turkey tag, a mountain lion tag, an archery 46 hunt permit, a muzzleloader permit, a steelhead trout permit and an anadromous 47 salmon permit. The director shall promptly transmit to the state treasurer all 48 moneys received pursuant to this subsection for deposit as follows: 49 (i) Four dollars ($4.00) in the set-aside account for the purposes of 50 section 36-111(1)(a), Idaho Code; 51 (ii) Two dollars ($2.00) in the set-aside account for the purposes of 52 section 36-111(1)(b), Idaho Code; 53 (iii) One dollar and fifty cents ($1.50) in the set-aside account for the 54 purposes of section 36-111(1)(c), Idaho Code; and 4 1 (iv) The balance in the fish and game account. 2 All persons purchasing a license pursuant to this subsection shall observe 3 and shall be subject to all rules of the commission regarding the fish and 4 wildlife of the state. 5 If the purchaser of this license does not meet the archery education 6 requirements of section 36-411(b), Idaho Code, then, notwithstanding the pro- 7 visions of section 36-304, Idaho Code, the archery hunt permit portion of this 8 license is invalid. The fee for this license will not change and the license 9 must be issued without the archery permit validation. 10 (g) Disabled Persons Licenses -- Combination -- Fishing. A license of the 11 first class may be had by any resident disabled person on payment of a fee as 12 specified in section 36-416, Idaho Code, for a combined fishing and hunting 13 license, and a fee as specified in section 36-416, Idaho Code, for a fishing 14 license, entitling the purchaser to the same privileges as the corresponding 15 license of the first class provides. A disabled person means a person who is 16 deemed disabled by the railroad retirement board pursuant to title 45 of the 17 United States Code, or certified as eligible for federal supplemental security 18 income (SSI); social security disability income (SSDI); a nonservice-connected 19 veterans pension; or a service-connected veterans disability benefit with 20 forty percent (40%) or more disability. 21 (h) Military Furlough Licenses -- Combination -- Fishing. A license of 22 the first class may be had by a resident person engaged in the military ser- 23 vice of the United States, while on temporary furlough or leave, possessing 24 the qualifications therein described on payment of a fee as specified in sec- 25 tion 36-416, Idaho Code, for a combined fishing and hunting license, and as 26 specified in section 36-416, Idaho Code, for a fishing license. 27 (i) Youth Small Game Licenses -- Hunting. A license of the second class 28 may be had by a resident of ten (10) or eleven (11) years of age on payment of 29 a fee as specified in section 36-416, Idaho Code, provided that the license 30 shall be valid only for hunting upland game birds (including turkeys), migra- 31 tory game birds, cottontail rabbits, pygmy rabbits, and unprotected and preda- 32 tory birds and animals of this state while accompanied in the field by the 33 holder of an adult Idaho hunting license. 34 SECTION 4. That Section 36-407, Idaho Code, be, and the same is hereby 35 amended to read as follows: 36 36-407. NONRESIDENT COMBINATION, FISHING, HUNTING, AND TRAPPING LICENSES 37 -- FEES -- RIGHTS UNDER. Licenses of the sixth class shall be issued to non- 38 residents in the several kinds and for fees as follows: 39 (a) Nonresident Hunting License. A license issued only to a person twelve 40 (12) years of age or older entitling said person to pursue, hunt, or kill game 41 birds, small game animals, unprotected birds and animals and predatory birds 42 and animals and to purchase game tags as provided in section 36-409(b), Idaho 43 Code. Provided, that a license may be issued to qualified persons who are 44 eleven (11) years of age to allow the application for a controlled hunt per- 45 mit; however, said persons shall not hunt until they are twelve (12) years of 46 age. A license of this kind may be had upon payment of a fee as specified in 47 section 36-416, Idaho Code. 48 (b) Nonresident Season Fishing License. A license entitling a person to 49 fish in the public waters of the state. A license of this kind may be had upon 50 payment of a fee as specified in section 36-416, Idaho Code. 51 (c) Nonresident Trapping License. A license entitling a person to trap 52 fur-bearing, unprotected, and predatory animals. A license of this kind may be 53 had upon payment of a fee as specified in section 36-416, Idaho Code, provid- 5 1 ing the state of residence of said person grants similar trapping license 2 privileges to residents of Idaho. 3 (d) Nonresident Nongame License. A license entitling a person to carry a 4 shotgun or rifle for the protection of livestock, or to pursue, hunt and kill 5 unprotected birds and animals and predatory birds and animals of this state. A 6 license of this kind may be had by a nonresident person who is twelve (12) 7 years of age or older upon payment of a fee as specified in section 36-416, 8 Idaho Code. This license shall be valid only during the period of January 1 to 9 August 31 of the calendar year in which issued, unless verified by the direc- 10 tor that the licensee requires such a license to authorize him to carry a 11 shotgun or rifle for the protection of livestock, in which case said license 12 shall be valid until December 31 of the year in which issued. 13 (e) Nonresident Two Day Small Game Hunting License. A license issued only 14 to a person twelve (12) years of age or older, entitling the person to hunt 15 upland game birds (to include turkeys), migratory game birds, cottontail rab- 16 bits, and pygmy rabbits. A person holding this license shall purchase the 17 appropriate required tags and permits, and may not hunt pheasants in an area 18 during the first five (5) days of the pheasant season in that area. A license 19 of this type may be had upon payment of a fee as specified in section 36-416, 20 Idaho Code. 21 (f) Falconry Meet Permit. The director may issue a special permit for a 22 regulated meet scheduled for a specific number of days upon payment of a fee 23 as specified in section 36-416, Idaho Code. Only trained raptors may be used 24 under the special permit issued under the provisions of this subsection. 25 (g) Daily Fishing License -- Resident May Purchase. A license entitling a 26 person to fish in the waters of the state on a day-to-day basis. A license of 27 this kind may be had by a resident or nonresident person (the provisions of 28 section 36-405, Idaho Code, notwithstanding), upon payment of a fee as speci- 29 fied in section 36-416, Idaho Code, for the first effective day and a fee as 30 specified in section 36-416, Idaho Code, for each consecutive day thereafter. 31 (h) Nonresident Three Day Fishing License with Steelhead or Salmon Per- 32 mit. A license entitling a nonresident to fish in the waters of the state for 33 a period of three (3) consecutive days for any fish, including steelhead trout 34 or anadromous salmon during an open season for those fish may be had upon pay- 35 ment of a fee as specified in section 36-416, Idaho Code. The three (3) day 36 license holder may fish for any species of fish, steelhead trout and anadro- 37 mous salmon subject to the limitations prescribed in rules promulgated by the 38 commission. A nonresident may purchase as many of the licenses provided in 39 this subsection as he desires provided that the nonresident is otherwise eli- 40 gible to do so. 41 (i) NonresidentJuvenileJunior Fishing License. A license entitling a 42 nonresident who is less than eighteen (18) years of age to fish in the waters 43 of this stateat any lawful time and during any open season, except for44steelhead trout or anadromous salmon,may be had upon payment of a fee as 45 specified in section 36-416, Idaho Code. 46 (j) Nonresident Combination Licenses. A license entitling the person to 47 hunt and fish for game animals, game birds, fish and unprotected and predatory 48 animals of the state may be had by a person twelve (12) years of age or older 49 upon payment of a fee as specified in section 36-416, Idaho Code. A license 50 may be issued to a qualified person who is eleven (11) years of age to allow 51 the application for a controlled hunt permit; however, the person shall not 52 hunt until he is twelve (12) years of age. 53 (k) Nonresident Junior Mentored Hunting License. A license entitling a 54 nonresident between twelve (12) and seventeen (17) years of age, inclusive, to 55 hunt game animals, upland game birds (including turkeys), migratory game 6 1 birds, cottontail rabbits, pygmy rabbits, and unprotected and predatory birds 2 and animals of this state only when accompanied in the field by the holder of 3 an adult Idaho hunting license. A person holding this license shall purchase 4 the appropriate required tags as provided in section 36-409(b), Idaho Code, 5 and permits. Provided, that a license may be issued to qualified persons who 6 are eleven (11) years of age to allow the application for a controlled hunt 7 permit; however, said persons shall not hunt until they are twelve (12) years 8 of age. A license of this kind may be had upon payment of a fee as specified 9 in section 36-416, Idaho Code. 10 (l) Nonresident Youth Small Game Licenses -- Hunting. A license entitling 11 a nonresident of ten (10) or eleven (11) years of age to hunt upland game 12 birds (including turkeys), migratory game birds, cottontail rabbits, pygmy 13 rabbits, and unprotected and predatory birds and animals of this state only 14 while accompanied in the field by the holder of an adult Idaho hunting license 15 may be had upon payment of a fee as specified in section 36-416, Idaho Code. 16 (m) Youth Hunter Education Graduate Licenses -- Hunting -- Resident May 17 Purchase. A license entitling a person between ten (10) and seventeen (17) 18 years of age, inclusive, to hunt upland game birds (except turkeys), migratory 19 game birds, cottontail rabbits, pygmy rabbits, and unprotected and predatory 20 birds and animals of this state only when accompanied in the field by the 21 holder of an adult Idaho hunting license. A person holding this license shall 22 purchase the appropriate required permits. A license of this kind may be 23 issued to a resident or nonresident person, notwithstanding the provisions of 24 section 36-405, Idaho Code, upon payment of a fee as specified in section 25 36-416, Idaho Code. 26 SECTION 5. That Section 36-409, Idaho Code, be, and the same is hereby 27 amended to read as follows: 28 36-409. GAME TAGS -- PERMITS -- FEES -- PENALTY. (a) Resident Game Tags. 29 A resident who has obtained a permit to hunt, as provided in section 36-401, 30 Idaho Code, or has purchased or obtained a license to hunt, as provided in 31 section 36-406, Idaho Code, upon payment of the fees provided herein shall be 32 eligible to receive a resident game tag to hunt and kill a moose, bighorn 33 sheep, mountain goat, elk, deer, antelope, mountain lion, bear, sandhill crane 34 or turkey in accordance with the laws of this state and rules promulgated by 35 the commission; provided further, that any person who holds a senior resident 36 combination license or any person who holds ayouthjunior combination or 37 hunting license or any disabled American veteran who holds a disabled combina- 38 tion license, may be issued a bear, deer,orelk, or turkey tag for a fee as 39 specified in section 36-416, Idaho Code; provided further, that resident game 40 tags may be issued only to those persons who meet residency requirements of 41 subsection (s) of section 36-202, Idaho Code. In the event an emergency is 42 declared to open a season to protect private property as provided in section 43 36-106(e)6.(B), Idaho Code, the affected landowner or his designee shall be 44 eligible to receive a resident deer, elk or antelope tag without charge; pro- 45 vided further, that resident game tags may be issued only to persons who qual- 46 ify as residents pursuant to section 36-202, Idaho Code. 47 (b) Nonresident Game Tags. A nonresident who has purchased a license to 48 hunt, as provided in section 36-407(a) or (k), Idaho Code, or has obtained a 49 license to hunt, as provided in section 36-406(e), Idaho Code, or a resident 50 who has purchased or obtained a license to hunt, as provided in section 51 36-406, Idaho Code, upon payment of the fees provided herein, shall be eligi- 52 ble to receive a nonresident tag to hunt and kill a moose, bighorn sheep, 53 mountain goat, elk, deer, antelope, mountain lion, bear, sandhill crane or 7 1 turkey in accordance with the laws of this state and rules promulgated by the 2 commission; provided further that a nonresident who has purchased a license to 3 hunt, as provided in section 36-407(k), Idaho Code, shall be eligible to 4 receive a junior mentored deer, elk, bear, or turkey tag for a fee as speci- 5 fied in section 36-416, Idaho Code. 6 (c) Game Tags Required. The appropriate tag must be had for the hunting 7 or taking of each and every one(1)of the aforementioned wildlife. Provided, 8 however, that the requirements for a mountain lion tag or a bear tag, as to 9 different periods of time and areas of the state, shall be determined and 10 specified by the commission. Provided further, that the commission may promul- 11 gate rules to allow a nonresident deer tag to be used to hunt and kill either 12 a bear or a mountain lion during the open season for deer in that area, unit 13 or zone as may be specified by the commission. All of said tags are to bear 14 and have serial numbers. 15 (d) Game Tag to Be Validated and Attached to Carcass. As soon as any per- 16 son kills any wildlife for which a tag is required, said tag, belonging to 17 him, must be validated and attached to said wildlife in a manner provided by 18 commission rule. 19 (e) Archery Permits. In addition to meeting the license and tag require- 20 ments provided in this chapter, any person participating in any controlled or 21 general game season which has been specifically designated as an archery hunt 22 must have in his possession an archery hunt permit which may be purchased at a 23 fee as specified in section 36-416, Idaho Code. 24 (f) Muzzleloader Permit. In addition to meeting the license and tag 25 requirements provided in this chapter, any person participating in any con- 26 trolled or general game season which has been specifically designated as a 27 muzzleloader hunt must have in his possession a muzzleloader permit which may 28 be purchased at a fee as specified in section 36-416, Idaho Code. 29 (g) Hound Hunter Permit -- Resident -- Nonresident. Any person using a 30 dog for the purpose of hunting or for taking, as defined in section 36-202, 31 Idaho Code, big game or furbearing animals must have in his possession a valid 32 hound hunter permit which may be purchased by resident and nonresident license 33 holders for a fee as specified in section 36-416, Idaho Code. 34 (h) Nonresident Bird of Prey Capture Permit. The commission may, under 35 rules as it may prescribe, issue a nonresident bird of prey capture permit. 36 This capture permit may be purchased by any licensed, nonresident falconer for 37 capturing birds of prey in Idaho. The fee for the permit shall be as specified 38 in section 36-416, Idaho Code, and the permit shall be issued under the condi- 39 tion that the nonresident's home state allows reciprocal raptor capturing 40 privileges for Idaho falconers. 41 (i) Wildlife Management Area (WMA) Pheasant Permit. The commission may, 42 under rules as it may prescribe, issue a wildlife management area pheasant 43 permit that must be purchased by all persons over sixteen (16) years of age 44 prior to hunting pheasants on state wildlife management areas designated by 45 the commission. The fee for the permit shall be as specified in section 46 36-416, Idaho Code. 47 (j) Bear Baiting Permit. The commission may, under rules as it may pre- 48 scribe, issue a bear baiting permit. Any person placing or using bait as may 49 be allowed by rule for the purpose of attracting bear must have in his posses- 50 sion a valid bear baiting permit which may be purchased by a license holder 51 for a fee as specified in section 36-416, Idaho Code. 52 (k) Migratory Bird Harvest Information Program Permit. The commission 53 may, as provided by federal laws or regulations and under rules as it may 54 prescribe, issue a migratory bird harvest information program permit that must 55 be purchased by all persons prior to hunting migratory game birds as required 8 1 by federal law or regulations. The fee for the permit shall be as specified 2 in section 36-416, Idaho Code. 3 (l) Dog Field Trial Permit. The commission may, under rules as it may 4 prescribe, issue a dog field trial permit to any person using birds for dog 5 field trials or training as may be allowed by rule. The permit may be pur- 6 chased for a fee as specified in section 36-416, Idaho Code. 7 (m) Idaho Nursing Home Facility Resident Fishing Permit. The commission 8 may, under rules as it may prescribe, issue an Idaho nursing home facility 9 resident fishing permit that must be purchased by an Idaho nursing home facil- 10 ity to allow residents of its facility to fish during the open season. Facili- 11 ties eligible to purchase this permit are: intermediate care facilities pro- 12 viding twenty-four (24) hour skilled nursing care, assisted living facilities 13 providing twenty-four (24) hour extensive assistance and skilled nursing 14 facilities providing twenty-four (24) hour skilled nursing. By purchasing this 15 permit the facility assumes full responsibility for and control over the 16 facility residents while using the permit. All laws, rules and proclamations 17 apply to the use of this permit and it is the responsibility of the facility 18 to assure compliance with all laws, rules and proclamations. In case of a 19 violation the facility shall be held accountable and any citations shall be 20 issued to the facility. The permit may be purchased for a fee as specified in 21 section 36-416, Idaho Code. 22 SECTION 6. That Section 36-410, Idaho Code, be, and the same is hereby 23 amended to read as follows: 24 36-410. STEELHEAD TROUT -- ANADROMOUS SALMON PERMITS. No person shall 25 fish for steelhead trout or anadromous salmon except as herein provided: 26 (a) Permits Required -- Fee. Any person holding a valid fishing or com- 27 bined fishing and hunting license of a class and kind mentioned in section 28 36-406 or in subsections (b) and (i) of section 36-407, Idaho Code, may pur- 29 chase one (1) steelhead trout permit or one (1) anadromous salmon permit at a 30 fee as specified in section 36-416, Idaho Code, for each kind of permit. The 31 person to whom such permits are issued shall then be entitled to fish for and 32 take steelhead trout and/or anadromous salmon subject to the limitations pre- 33 scribed in this title and rules promulgated by the commission. Permits shall 34 be valid only during the period of time that the corresponding basic license 35 is valid. 36 (b) Unlicensed Resident. Bona fide residents of Idaho who are expressly 37 exempt from license requirements to fish in the public waters of the state may 38 choose one (1) of the following options: 39 1. Purchase and use such permits as an individual; or 40 2. May fish for and take steelhead trout and/or anadromous salmon without 41 having permits therefor if accompanied by a properly licensed permit 42 holder, provided that any such fish caught shall be included in the daily, 43 seasonal and possession limit of the accompanying licensed permit holder. 44 (c) Unlicensed Nonresident Children. Unlicensed nonresident children 45 under the age of fourteen (14) years shall not be eligible to obtain a 46 steelhead trout or anadromous salmon permit, but may take such fish if accom- 47 panied by a holder of a valid license and permit, provided that any steelhead 48 trout or anadromous salmon caught by such children shall be included in the 49 daily, seasonal and possession limit of the accompanying licensed permit 50 holder. 51 SECTION 7. That Section 36-412, Idaho Code, be, and the same is hereby 52 amended to read as follows: 9 1 36-412. EDUCATION PROGRAMS -- INSTRUCTOR QUALIFICATIONS -- FEE. (a) The 2 fish and game commission shall prescribe and administer education programs in 3 hunting and archery. Such programs shall provide instruction in the safe 4 handling of lawful hunting equipment. The programs shall also include instruc- 5 tion on wildlife and natural resource conservation, good conduct and respect 6 for the rights and property of others, and survival in the outdoors. The com- 7 mission may enter into agreements with public or private agencies and individ- 8 uals in carrying out the provisions of this subsection. 9 (b) The department of fish and game shall recruit competent volunteer 10 instructors. The department shall provide training for the instructors in the 11 safe handling of legal hunting equipment, conservation of wildlife and natural 12 resources, good conduct and respect for the rights and property of others, 13 outdoor survival, and other appropriate subjects for training instructors. 14 Instructors shall be issued certificates and shall on a voluntary basis, give 15 instruction in education programs as established by the department of fish and 16 game, to all eligible applicants. 17 (c) The commission shall establish fees for each program not to exceed 18 eight dollars ($8.00) for persons who are age seventeen (17) years and under 19 and not to exceed eight dollars ($8.00) for persons age eighteen (18) years 20 and older, to be assessed each individual obtaining instruction in hunter edu- 21 cation for reimbursement for furnished materials. All students successfully 22 completing the course of instruction shall be issued a certificate of comple- 23 tion in hunter safety and good hunting conduct. The department may also issue 24 a youth hunter education graduate hunting license to students successfully 25 completing the course or allow the student to purchase a junior hunting 26 license at a reduced fee pursuant to rules adopted by the commission. 27 SECTION 8. That Section 36-1508, Idaho Code, be, and the same is hereby 20 amended to read as follows: 21 36-1508. SHOOTING FROM PUBLIC HIGHWAY -- CHILDREN IN POSSESSION OF FIRE- 22 ARMS. No person shall: 23 (a) Shoot from Public Highway. Discharge any firearm from or across a 24 public highway. 25 (b) Children with Firearms. No person under the age of twelve (12) years 26 shall have in his possession any shotgun, rifle or other firearm while in the 27 fields or forests or in any tent, camp, auto or any other vehicle in the state 28 of Idaho, except that the holder of a youth small game license or youth hunter 29 education graduate license, if accompanied by an adult licensed to hunt in the 30 state of Idaho, may possess a firearm for hunting while in the fields or for- 31 ests. 32 SECTION 10. This act shall be in full force and effect on and after Janu- 33 ary 1, 2003.
STATEMENT OF PURPOSE RS 115l8C2 This bill benefits and encourages youth to go hunting and fishing by making a number of changes to the Fish and Game Code. This bill creates a Youth Small Game License, which will allow resident ten and eleven year olds to hunt small game with a licensed adult. The current law does not allow hunting until age twelve. A Nonresident Junior Mentored Hunting License is created which will allow nonresident youth to hunt with an Idaho licensed adult for the same price as resident youth. This license will allow visiting youth to hunt with friends and family. The Nonresident Junior Fishing License is decreased in price and amended to allow the purchase of a salmon or steelhead permit. This bill creates a Youth Hunter Education Graduate License to allow youth to hunt most small game with a licensed adult. It authorizes the Commission to establish rules for issuing the license. A new reduced price turkey tag for resident junior, senior or disabled American Veterans is created as well as reduced price deer, elk, bear and turkey tags for Nonresident Junior Mentored Hunters. This bill also makes several technical and terminology corrections. FISCAL IMPACT The Junior Mentored Hunting License and tags will result in an estimated lost revenue of $151,000 generated by the current full price sales to nonresident 12 - 17 year aids. This loss will be offset by sales to nonresident youth who do not hunt now and potentially additional sales to adult mentors. The reduced revenue for the Nonresident Junior Fishing License should also be offset by additional sales. The Youth Small Game License will generate an unknown amount of additional revenue. The cost of the Hunter Education Graduate Licenses will come from the current hunter education course fee.
