  1                                        AN ACT
  2    RELATING TO FEES OF THE STATE BAR ASSOCIATION; AMENDING SECTION  3-409,  IDAHO
  3        CODE,  TO  DELETE  OBSOLETE  LANGUAGE  AND TO REVISE LICENSING FEES OF THE
  4        IDAHO STATE BAR ASSOCIATION FOR THE YEAR 2003 AND EACH YEAR THEREAFTER.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 3-409, Idaho Code, be, and  the  same  is  hereby
  7    amended to read as follows:
                                                                        
  8        3-409.  LICENSE FEES AND APPROPRIATIONS. Every person practicing, or hold-
  9    ing himself out as practicing law within this state, or holding himself out to
 10    the public as a person qualified to practice or carry on the calling of a law-
 11    yer  within this state, except state and United States judges of the courts of
 12    record within this state, shall, prior to so doing and no later than  February
 13    1  of  each year pay to the board of commissioners of the Idaho state bar as a
 14    license fee the following amounts:
 15        For the year 1999: For the calendar year of admission to the  practice  of
 16    law  in  the  state  of Idaho if admitted prior to July 1: one hundred dollars
 17    ($100); For the calendar year of admission to the practice of law in the state
 18    of Idaho if admitted after July 1: sixty dollars ($60.00); Each year  for  the
 19    next  three  (3)  calendar years following the calendar year of admission: two
 20    hundred five dollars ($205); Each year after the third full year of admission:
 21    two hundred seventy-five dollars ($275); Each year following the calendar year
 22    of the lawyer's seventy-second birthday:  fifty  dollars  ($50.00);  Affiliate
 23    members for each calendar year: one hundred five dollars ($105).
 24        For  the  year  2000  and  each  year thereafter: For the calendar year of
 25    admission to the practice of law in the state of Idaho if  admitted  prior  to
 26    July 1: one hundred fifteen dollars ($115); For the calendar year of admission
 27    to  the practice of law in the state of Idaho if admitted after July 1: sixty-
 28    five dollars ($65.00); Each year for the next three (3) calendar years follow-
 29    ing the calendar year of admission: two hundred thirty  dollars  ($230);  Each
 30    year  after  the  third  full  year of admission three hundred fifteen dollars
 31    ($315); Each year following the calendar year of the  lawyer's  seventy-second
 32    birthday:   fifty-five  dollars  ($55.00); Affiliate members for each calendar
 33    year one hundred twenty dollars ($120).
 34        For the year 2003 and each year  thereafter:  For  the  calendar  year  of
 35    admission  to  the  practice of law in the state of Idaho if admitted prior to
 36    July 1: one hundred forty dollars ($140); For the calendar year  of  admission
 37    to  the practice of law in the state of Idaho if admitted after July 1: ninety
 38    dollars ($90.00); Each year for the next three (3)  calendar  years  following
 39    the  calendar  year  of admission: two hundred fifty-five dollars ($255); Each
 40    year after the third full  year  of  admission  three  hundred  forty  dollars
 41    ($340);  Each  year following the calendar year of the lawyer's seventy-second
 42    birthday:  fifty-five dollars ($55.00); Affiliate members  for  each  calendar
 43    year one hundred twenty dollars ($120).

  1        The  moneys thus collected, together with other revenues shall be adminis-
  2    tered under the direction of the board of commissioners of the Idaho state bar
  3    for the purpose of administering the Idaho state bar,  encouraging  local  bar
  4    associations,  promoting legal education seminars, fostering relations between
  5    the public and the bar and for the purpose of establishing and  maintaining  a
  6    clients' security fund which shall be administered by the Idaho state bar com-
  7    missioners  under  rules approved by the supreme court, provided that the cli-
  8    ents' security fund shall be funded by assessment of the members of the  Idaho
  9    state  bar not to exceed ten dollars ($10.00) per member per year, independent
 10    of the license fee. All moneys received and expended by the  commissioners  of
 11    the  Idaho  state  bar shall be audited annually by a certified public accoun-
 12    tant.

Statement of Purpose / Fiscal Impact


                     STATEMENT OF PURPOSE
                          RS 11987

Amends existing law to revise licensing fees of the Idaho State Bar 
Association for the year 2003 and each year thereafter. This law 
sets fees for the calendar year of admission to the practice of law 
in the State of Idaho, if admitted prior to July 1, at one hundred 
forty dollars ($140.00). For the calendar year of admission to the 
practice of law in the State of Idaho, if admitted after July, the 
fee is ninety dollars ($90.00). For the next three (3) calendar 
years following the calendar year of admission the fee shall be two 
hundred fifty five dollars ($255.00) for each year. After the third 
full year of admission, the fee shall be three hundred forty 
dollars ($340.00). For each year following the calendar year of the 
lawyer’s seventy-second birthday the fee will be fifty-five dollars 
($55.00). Affiliate members shall pay a fee of $120.00 for each 
calendar year. For those categories that are increased, the 
additional amount is $25.00 per year.


                          FISCAL IMPACT

There is no fiscal impact to the General Fund.
