|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 641 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO CARE FACILITIES REGULATED BY THE BOARD OF HEALTH AND WELFARE; 3 AMENDING SECTION 39-3351, IDAHO CODE, TO PROVIDE AN ADDITIONAL EXEMPTION 4 FROM THE REQUIREMENTS FOR LICENSURE; AND AMENDING SECTION 39-3551, IDAHO 5 CODE, TO PROVIDE AN ADDITIONAL EXEMPTION FROM THE REQUIREMENTS FOR LICEN- 6 SURE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 39-3351, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 39-3351. EXEMPTIONS. The provisions of this chapter do not apply to any 11 of the following: 12 (1) Any health facility as defined by chapter 13, title 39, Idaho Code. 13 (2) Any house, institution, hotel, congregate housing project for the 14 elderly, retirement home or other similar place that is limited to providing 15 one (1) or more of the following: housing, meals, transportation, housekeep- 16 ing, or recreational and social activities; or that have residents accessing 17 supportive services from an entity approved to provide such services in Idaho 18 and holding no legal ownership interest in the entity operating the facility. 19 (3) Any arrangement for the receiving and care of persons by a relative. 20 (4) A private home with four (4) or fewer residents where the residents 21 make payment to the owner of the home from their personal funds. 22 (5) Any similar facility determined by the director. 23 SECTION 2. That Section 39-3551, Idaho Code, be, and the same is hereby 24 amended to read as follows: 25 39-3551. EXEMPTIONS. STATEMENT OF PURPOSE RS 12042 To exempt from regulation of the bureau of facility standards those certified family homes where only private-pay clients reside. FISCAL IMPACT There will be some savings as the bureau of facility standards is required to supervise and inspect fewer facilities.
