STUDENT TEACHERS - STIPEND - Adds to existing law to create a student
teacher stipend program to be awarded to qualifying students from funds
distributed to the Idaho institutions of higher learning for the purpose of
providing financial support during the required semester or semesters of
student teaching; to provide legislative intent that the teacher stipend
program shall receive first priority in the disbursement of Special
Leveraging Educational Assistance Program moneys; and to provide
legislative intent should the available amount of money in fiscal year 2003

  1                                        AN ACT
  2    RELATING TO STUDENT TEACHER STIPENDS; AMENDING CHAPTER  37,  TITLE  33,  IDAHO
  3        CODE, BY THE ADDITION OF A NEW SECTION 33-3723, IDAHO CODE, TO PROVIDE FOR
  4        STUDENT  TEACHER  STIPENDS TO BE AWARDED TO QUALIFYING STUDENTS FROM FUNDS
  5        DISTRIBUTED TO IDAHO INSTITUTIONS OF HIGHER LEARNING FOR  THE  PURPOSE  OF
  6        PROVIDING  FINANCIAL  SUPPORT DURING THE REQUIRED SEMESTER OR SEMESTERS OF
  7        STUDENT TEACHING; AND TO  PROVIDE  LEGISLATIVE  INTENT  THAT  THE  STUDENT
  8        TEACHER STIPEND PROGRAM SHALL RECEIVE FIRST PRIORITY IN THE AWARDS OF SPE-
  9        CIAL  LEVERAGING EDUCATIONAL ASSISTANCE PROGRAM MONEYS AND TO PROVIDE LEG-
 10        ISLATIVE INTENT SHOULD THE AVAILABLE  AMOUNT  OF  MONEY  BE  INCREASED  OR
 11        DECREASED.
                                                                        
 12    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 13        SECTION  1.  That  Chapter  37,  Title 33, Idaho Code, be, and the same is
 14    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 15    ignated as Section 33-3723, Idaho Code, and to read as follows:
                                                                        
 16        33-3723.  STUDENT  TEACHER  STIPEND. (1)  It is hereby declared that it is
 17    in the public interest to remedy the shortage of teachers  in  this  state  by
 18    providing  financial  assistance  to  qualified,  talented students who cannot
 19    afford to support themselves during the required semester or semesters of stu-
 20    dent teaching while such students are pursuing a postsecondary education  pro-
 21    gram at an Idaho institution of higher learning.
 22        (2)  Any Idaho student who is a bona fide resident of the state and who is
 23    enrolled  in a state-approved teacher preparation program may apply for a stu-
 24    dent teacher stipend from the Idaho college or university he attends. To qual-
 25    ify for a stipend, a student shall:
 26        (a)  Be pursuing a program of study which  will  qualify  the  student  to
 27        receive an Idaho teaching certificate upon completion of his studies;
 28        (b)  Be  majoring  in  an  area  of teaching in which there is currently a
 29        shortage of teachers, as determined annually by the state board of  educa-
 30        tion;
 31        (c)  Demonstrate  a  need  for financial assistance, as defined by rule of
 32        the state board of education, on forms provided by the college or  univer-
 33        sity; and
 34        (d)  Agree  in  writing  on  a  form provided by the college or university
 35        that, as a condition of accepting  such  stipend,  the  student  will  not
 36        accept employment outside of the educational environment during the semes-
 37        ter  or  semesters  of student teaching and, when qualified, will teach in
 38        the state of Idaho for a minimum of three (3) years. The  recipient  of  a
 39        stipend  shall  have  not  more  than five (5) years after the stipend was
 40        accepted in which to  fulfill  the  three  (3)  year  teaching  obligation
 41        required herein.
 42        (3)  The  student  loan  office  of each institution of higher learning is
 43    directed to administer the student teacher stipend program, including  supply-

  1    ing  all  necessary  forms;  consulting with the appropriate department of the
  2    college or university in the selection of qualified applicants;  and  awarding
  3    stipends to qualified recipients, subject to funds available for such purpose.
  4    Stipends  may be awarded in any amount as determined by the college or univer-
  5    sity from funds distributed for such purpose, up to one thousand five  hundred
  6    dollars  ($1,500)  per  semester  but  not  to  exceed  three thousand dollars
  7    ($3,000) per qualified recipient.
  8        (4)  The student loan office of each institution  of  higher  learning  is
  9    directed to develop and institute a procedure for verifying that the recipient
 10    of a stipend fulfilled his obligation to teach in Idaho pursuant to the agree-
 11    ment signed by the student as provided in subsection (2)(d) of this section.
                                                                        
 12        SECTION  2.  LEGISLATIVE  INTENT. It is the intent of the Legislature that
 13    the student teacher stipend program created in Section  33-3723,  Idaho  Code,
 14    shall receive first priority when the state's institutions of higher education
 15    award  the  Special Leveraging Educational Assistance Program funding that was
 16    appropriated on an ongoing basis in Chapter 311, Laws of 2001,  by  the  First
 17    Regular Session of the Fifty-sixth Idaho Legislature.
 18        These  moneys  are  contained  in  the  appropriation for scholarships and
 19    grants in special programs for the State Board of Education and the  Board  of
 20    Regents of the University of Idaho and consist of one hundred thousand dollars
 21    ($100,000)  of General Fund money and fifty thousand dollars ($50,000) of fed-
 22    eral funds.
 23        Should these moneys be increased by federal  or  legislative  action,  not
 24    more  than  three  hundred thousand dollars ($300,000) shall be awarded by the
 25    state's institutions of higher education for the student teacher stipend  pro-
 26    gram.
 27        Should  these moneys be reduced by federal or legislative action, the num-
 28    ber of stipends or the amount of each stipend awarded shall be reduced accord-
 29    ingly.

Statement of Purpose / Fiscal Impact

This legislation addresses the teacher shortage of grades K-12 in
Idaho s schools. A stipend would be awarded to student teachers
enrolled in state approved teacher preparation programs during the
semester or semesters that they teach. Applicants for the award must
be majoring in an area of teacher shortage and show financial need.
Recipients would be required to sign a contract stating that they
would not take on any employment other than their student teaching
and that they would teach in Idaho for at least 3 years.


                        FISCAL IMPACT
                               
                               
This legislation does not require a new appropriation of General Fund
money. Last session, the Legislature appropriated $100,000 from the
General Fund and $50,000 from the U.S. Department of Education for
the Special Leveraging Educational Assistance Program. The SLEAP
program provides grants to eligible postsecondary students who
demonstrate financial need. The stipend program contained in this
bill will give priority to students pursuing a degree program leading
to a teaching career when those SLEAP grants are disbursed. The use
of SLEAP grants is consistent with the requirements by the U.S.
Department of Education for the SLEAP program.
