1 AN ACT
2 APPROPRIATING MONEYS TO THE DEPARTMENT OF LANDS FOR FISCAL YEAR 2003; LIMITING
3 THE NUMBER OF AUTHORIZED FULL-TIME EQUIVALENT POSITIONS; AND INCREASING
4 THE LIMIT AUTHORIZED FOR FOREST PEST DEFICIENCY WARRANTS FROM $250,000 TO
5 $500,000 FOR 2002.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. There is hereby appropriated to the Department of Lands the
8 following amounts to be expended for the designated programs according to the
9 designated expense classes from the listed funds for the period July 1, 2002,
10 through June 30, 2003:

32 SECTION 2. In accordance with Section 67-3519, Idaho Code, the Department
33 of Lands is authorized no more than two hundred forty-nine and sixty-one hun-
34 dredths (249.61) full-time equivalent positions at any point during the period
35 July 1, 2002, through June 30, 2003, for the programs specified in Section 1
36 of this act, unless specifically authorized by the Governor. The Joint
37 Finance-Appropriations Committee will be notified promptly of any increased
38 positions so authorized.
39 SECTION 3. In the fall of 2000, the Director of the Department of Lands,
40 with the approval of the State Board of Land Commissioners, declared a zone of
41 tussock moth infestation in the Moscow Mountain area. Although treatments dur-
42 ing the summer of 2001 were very effective, the Department has determined the
43 need for further treatment during 2002. Preliminary estimates indicate a proj-
44 ect cost of about $1,200,000. The Forest Service will provide a $600,000 grant
45 to treat pest outbreaks this season.
46 In accordance with Section 38-602, Idaho Code, the State Board of Land
47 Commissioners may issue deficiency warrants against the General Fund to sup-
48 press and eradicate forest pests. The limit authorized by Section 38-602,
49 Idaho Code, is hereby increased from $250,000 to $500,000 for 2002. This limit
50 is for the General Fund only and does not include federal grants or reimburse-
51 ments from cooperating landowners. Costs for treatments other than to state
52 lands shall be reimbursed according to cooperative agreements approved by the

1 State Board of Land Commissioners. The Joint Finance-Appropriations Committee
2 recommends that cooperating landowners pay 12.5% of the total costs of treat-
3 ments to their properties.

This is the fiscal year 2003 appropriation to the Idaho Department of Lands in the amount of $33,048,400. The bill caps the number of full-time equivalent positions at 249.61. It also includes a section increasing the limit authorized for forest pest deficiency warrants from $250,000 to $500,000 for calendar year 2002.
