  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE SUPREME COURT FOR FISCAL YEAR 2003;  APPROPRIATING
  3        MONEYS  FROM  THE  GENERAL  FUND TO THE GUARDIAN AD LITEM FUND; EXPRESSING
  4        LEGISLATIVE INTENT WITH  RESPECT  TO  CERTAIN  EXPENDITURES;  CAPPING  THE
  5        AMOUNT ALLOCATED FOR ADMINISTRATIVE OVERHEAD IN THE GUARDIAN AD LITEM PRO-
  6        GRAM;  AND  ENCOURAGING  PRESERVATION  OF THE DRUG COURTS AND FAMILY COURT
  7        SERVICES PROGRAMS.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  There is hereby appropriated to the Supreme Court, the follow-
 10    ing amounts, to be expended from the listed funds for the period July 1, 2002,
 11    through June 30, 2003:

 19        SECTION 2.  There is hereby appropriated $446,500 from the General Fund to
 20    be deposited in the Guardian Ad Litem  Fund  for  the  period  July  1,  2002,
 21    through June 30, 2003.
                                                                        
 22        SECTION  3.  It  is  legislative intent that of the amount appropriated in
 23    Section 1 of this act, an amount not to exceed $5,000 may be  used  in  accor-
 24    dance  with  rules  set  by the Supreme Court, to assist in defraying expenses
 25    relating to or resulting from the discharge of  the  Supreme  Court  Justices'
 26    official  duties  and the official duties of the Supreme Court. Further, it is
 27    legislative intent that an amount, not to exceed $1,500 of the  amount  appro-
 28    priated  in Section 1 of this act, may be used in accordance with rules set by
 29    the Supreme Court to assist in defraying expenses  relating  to  or  resulting
 30    from  the  discharge  of  the Court of Appeals Judges' official duties and the
 31    official duties of the Court of Appeals. Such moneys shall  be  accounted  for
 32    according  to  the provisions of Chapter 36, Title 67, Idaho Code, and Section
 33    67-3516, Idaho Code.
                                                                        
 34        SECTION 4.  It is legislative intent that the amount allocated for  admin-
 35    istrative  overhead to the administrative agency selected by the Idaho Supreme
 36    Court for the Guardian Ad Litem Program be capped at $30,000  for  the  period
 37    July 1, 2002, through June 30, 2003.
                                                                        
 38        SECTION  5.  The  Legislature  joins  the Supreme Court in the recognition
 39    that Drug Courts and Family Court Services preserve families, increase  public
 40    safety  and provide cost-effective alternatives to incarceration. The Legisla-

  1    ture encourages the Supreme Court to preserve, to the extent  possible,  these
  2    programs as envisioned by the Supreme Court and the Legislature in the face of
  3    budget reductions.
