|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT MEMORIAL NO. 16 BY EDUCATION COMMITTEE 1 A JOINT MEMORIAL 2 TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS 3 ASSEMBLED, AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF 4 IDAHO IN THE CONGRESS OF THE UNITED STATES. 5 We, your Memorialists, the House of Representatives and the Senate of the 6 State of Idaho assembled in the Second Regular Session of the Fifty-sixth 7 Idaho Legislature, do hereby respectfully represent that: 8 WHEREAS, in 1975 our country took a major step forward in promoting the 9 inclusion and equality of one of our most disenfranchised groups of citizens; 10 and 11 WHEREAS, passage of the Education for All Handicapped Children Act, now 12 known as the Individuals with Disabilities Education Act (IDEA), reaffirmed 13 the American principle that all children deserve a free and appropriate public 14 education; and 15 WHEREAS, the federal government made a commitment to pay forty percent of 16 the cost for children with special educational needs; and 17 WHEREAS, over the years the federal appropriations have ranged from seven 18 to fifteen percent of the total cost; and 19 WHEREAS, the federal contribution has always fallen far short of the con- 20 gressional commitment to fully fund IDEA; and 21 WHEREAS, local and state budgets have been forced to absorb the shortfall; 22 and 23 WHEREAS, after twenty-five years, the magnitude of that shortfall demands 24 a new approach; and 25 WHEREAS, funding for IDEA should be moved out of the discretionary budget 26 and into mandatory spending for the federal contribution; and 27 WHEREAS, when IDEA funding nears the forty percent commitment, schools 28 will be able to free up resources for other educational programs and services. 29 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 30 sion of the Fifty-sixth Idaho Legislature, the House of Representatives and 31 the Senate concurring therein, that we urgently and respectfully request that 32 the Congress of the United States make special education funding mandatory and 33 fulfill its commitment on a long overdue promise to provide funding at the 34 forty percent level. 35 BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representa- 36 tives be, and she is hereby authorized and directed to forward a copy of this 37 Memorial to the President of the Senate and the Speaker of the House of Repre- 38 sentatives of Congress, and the congressional delegation representing the 39 State of Idaho in the Congress of the United States.
STATEMENT OF PURPOSE RS 11660C1 The purpose of this joint memorial is to urge the U.S. congress to honor the financial commitment made in 1975 when they passed the Individuals with Disabilities Education Act (IDEA). The federal government made a commitment to pay 40 percent of the cost for children with special educational needs. Over the years, the federal appropriations have ranged from seven percent to 15 percent of the total cost of the program. FISCAL IMPACT There would be greatly increased revenue for school districts who are struggling to pay the costs of special education.
