  2    TO THE PRESIDENT OF THE UNITED STATES, TO THE SECRETARY OF  THE  INTERIOR,  TO
  3        THE  SENATE  AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS
  4        ASSEMBLED, TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF IDAHO
  5        IN THE CONGRESS OF THE UNITED STATES, TO THE  GOVERNOR  OF  THE  STATE  OF
  6        IDAHO AND THE ATTORNEY GENERAL OF THE STATE OF IDAHO.
                                                                        
  7        We,  your Memorialists, the House of Representatives and the Senate of the
  8    State of Idaho assembled in the Second  Regular  Session  of  the  Fifty-sixth
  9    Idaho Legislature, do hereby respectfully represent that:
                                                                        
 10        WHEREAS,  the  Tenth  Amendment  of the United States Constitution states,
 11    "The powers not delegated to the United States by the Constitution,  nor  pro-
 12    hibited  by  it  to the states, are reserved to the states respectively, or to
 13    the people"; and
 14        WHEREAS, the United  States  federal  government  should  acknowledge  the
 15    intent  of the Tenth Amendment of the United States Constitution by respecting
 16    the sovereignty of the states; and
 17        WHEREAS, we believe that the provisions of the Tenth Amendment of the Con-
 18    stitution of the United States give states the right to  protect  the  safety,
 19    property and economic well-being of their citizens; and
 20        WHEREAS,  the United States Fish and Wildlife Service, without the consent
 21    of the constitutional officers and the Legislature  of  the  State  of  Idaho,
 22    introduced Canadian gray wolves into the state of Idaho; and
 23        WHEREAS,  large wolf populations in Canada and Alaska indicate that wolves
 24    are not endangered and therefore do  not  qualify  for  protection  under  the
 25    Endangered Species Act; and
 26        WHEREAS,  the United States Fish and Wildlife Service's wolf recovery pro-
 27    gram violates states rights, and must be dealt with accordingly; and
 28        WHEREAS, pursuant to Section 67-6302,  Idaho  Code,  we  believe  that  no
 29    agency of the United States has the constitutional right to introduce any spe-
 30    cies  into  any  state without first obtaining the consent of the duly elected
 31    state legislature; and
 32        WHEREAS, House Joint Memorial No. 5, adopted overwhelmingly by  the  First
 33    Regular  Session  of  the  Fifty-sixth Idaho Legislature, called for immediate
 34    delisting and removal of the Canadian gray wolf by  whatever  means  necessary
 35    with monetary compensation for loss of Idaho's wildlife resources; and
 36        WHEREAS, the wolf population in Idaho is out of control, unmanageable, and
 37    a serious threat to wild game herds and domestic livestock; and
 38        WHEREAS,  agri-business,  livestock  production  and  hunting  of game are
 39    mainstays of the Idaho economy; and
 40        WHEREAS, Section 67-6301, Idaho Code, created and funds  a  Constitutional
 41    Defense  Council  whose purpose is to restore, maintain and advance the sover-
 42    eignty and authority over issues that affect this state and the well-being  of
 43    its citizens.
 44        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-

  1    sion of the Fifty-sixth Idaho Legislature, the House of Representatives    and
  2    the  Senate  concurring  therein, that we affirm our sovereign right to remove
  3    the Canadian gray wolf, or solely determine the  method  of  management,  such
  4    method to be funded by the United States Fish and Wildlife Service since it is
  5    the agency that introduced wolves into Idaho.
  6        BE  IT  FURTHER  RESOLVED that the Chief Clerk of the House of Representa-
  7    tives be, and she is hereby authorized and directed to forward a copy of  this
  8    Memorial  to the President of the United States, George W. Bush, the Secretary
  9    of the Interior, Gale A. Norton, the President of the Senate and  the  Speaker
 10    of the House of Representatives of Congress, the congressional delegation rep-
 11    resenting  the State of Idaho in the Congress of the United States, the Gover-
 12    nor of the State of Idaho, Dirk Kempthorne, and the Attorney  General  of  the
 13    State of Idaho, Alan G. Lance.

Constitution is the supreme law of our land and supercedes an Act
of Congress.
