|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE BILL NO. 1276 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO THE IDAHO SNOWSKIER LICENSE PLATES; AMENDING SECTION 49-419, IDAHO 3 CODE, TO DELETE REFERENCE TO THE 2002 OLYMPIC WINTER GAMES STRATEGY PRO- 4 GRAM AND TO PROVIDE THAT ANY MONEYS EXPENDED BY THE DEPARTMENT OF COMMERCE 5 FOR PROMOTION OF IDAHO'S SKI INDUSTRY SHALL BE DONE IN CONSULTATION WITH 6 THE IDAHO SKI AREA ASSOCIATION; DECLARING AN EMERGENCY AND PROVIDING RET- 7 ROACTIVE APPLICATION. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 49-419, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 49-419. IDAHO SNOWSKIER PLATES. (1) On and after January 1, 1999, any 12 person who is the owner of a vehicle registered under the provisions of sec- 13 tion 49-402, Idaho Code, or registered under any other section of law for 14 which the purchase of special plates is allowed, may apply for and upon 15 department approval receive special Idaho snowskier license plates in lieu of 16 regular license plates. The provisions of this section shall not apply to any 17 vehicle with a registered maximum gross weight over twenty-six thousand 18 (26,000) pounds. Availability of Idaho snowskier license plates for other 19 vehicles shall be subject to the rules, policies and procedures of the depart- 20 ment. 21 (2) In addition to the regular registration fee required in chapter 4, 22 title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol- 23 lars ($35.00) for the initial issuance of the plates, and twenty-five dollars 24 ($25.00) upon each succeeding annual registration. Ten dollars ($10.00) of the 25 initial fee and ten dollars ($10.00) of the renewal fee shall be deposited in 26 the state highway account and shall be used to fund the cost of administration 27 of this special license plate program. Twenty-five dollars ($25.00) of each 28 initial fee and fifteen dollars ($15.00) of each renewal fee shall be depos- 29 ited by the state treasurer in the division of tourism fund within the depart- 30 ment of commerce for use inthe 2002 Olympic winter games strategy program and31forgeneral promotion of Idaho's ski industry. 32 (3) Whenever title or interest in a vehicle registered under the provi- 33 sions of this section is transferred or assigned, the owner may transfer the 34 special plates to another vehicle upon payment of the required transfer fees. 35 The owner may only display the plates on another vehicle upon receipt of the 36 new registration from the department. 37 (4) The Idaho snowskier license plate shall be of a color and design com- 38 parable to the standard issue of license plates with blue numerals on a red, 39 white and blue background, except that the word "Idaho" shall appear on each 40 plate and the county designator shall be omitted to provide for distinguishing 41 designs and slogans, acceptable to the Idaho ski areas association, to be 42 added to the plate. The design shall be approved by the department and shall 43 utilize a numbering system as determined by the department. Initial costs of 2 1 the plate program, including costs of plate design, shall be paid by the Idaho 2 ski areas association. 3 (5) Sample Idaho snowskier license plates may be purchased for a fee of 4 thirty dollars ($30.00), ten dollars ($10.00) of which shall be deposited in 5 the state highway account and twenty dollars ($20.00) of which shall be depos- 6 ited in the division of tourism fund within the department of commerce for use 7 inthe 2002 Olympic winter games strategy program and forgeneral promotion of 8 Idaho's ski industry. Any moneys expended by the department of commerce for 9 promotion of Idaho's ski industry shall be done in consultation with the Idaho 10 ski area association. No additional fee shall be charged for personalizing 11 sample plates. 12 SECTION 2. An emergency existing therefor, which emergency is hereby 13 declared to exist, this act shall be in full force and effect on and after its 14 passage and approval, and retroactively to January 1, 2002.

STATEMENT OF PURPOSE RS 11573 The purpose of this legislation is to delete two references to the 2002 Olympic Winter Games Strategy Program. It further provides that any money spent by the Department of Commerce for the promotion of Idaho's ski industry will be done in consultation with the Idaho Ski Area Association. There is an emergency clause which will make the legislation, after its passage, effective retroactive to January 1, 2002. FISCAL IMPACT None.
