                              BY JUDICIARY AND RULES COMMITTEE
                                                                        
  1                                        AN ACT
  2    RELATING TO CRIMES AND PUNISHMENTS; REPEALING SECTION 18-3313, IDAHO CODE; AND
  3        AMENDING CHAPTER 33, TITLE 18, IDAHO CODE, BY THE ADDITION OF A  NEW  SEC-
  4        TION  18-3313,  IDAHO  CODE, TO PROVIDE THAT SPECIFIED CONDUCT RELATING TO
  5        THREATS, FALSE REPORTS AND HOAXES SHALL CONSTITUTE A FELONY AND TO PROVIDE
  6        FOR PUNISHMENT.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Section 18-3313, Idaho Code, be, and the same  is  hereby
  9    repealed.
                                                                        
 10        SECTION  2.  That  Chapter  33,  Title 18, Idaho Code, be, and the same is
 11    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 12    ignated as Section 18-3313, Idaho Code, and to read as follows:
                                                                        
 13        18-3313.  THREATS,  FALSE  REPORTS AND HOAXES. (1) A person is guilty of a
 14    felony who willfully makes any threat, or maliciously conveys  false  informa-
 15    tion knowing the information to be false, concerning:
 16        (a)  The  presence of any explosive or harmful biological or chemical sub-
 17        stance; or
 18        (b)  An attempt to kill, injure or intimidate any person, or to unlawfully
 19        damage or destroy any building, vehicle or other real  or  personal  prop-
 20        erty,  by  means of fire, explosion or harmful biological or chemical sub-
 21        stances.
 22        (2)  A person who maliciously places any device or substance in any  loca-
 23    tion with the intent to induce the belief in another person that the device or
 24    substance  is  an  explosive  or a harmful biological or chemical substance is
 25    guilty of a felony.
 26        (3)  A violation of the provisions of this section shall be punishable  by
 27    imprisonment for a term of not more than ten (10) years, by a fine of not more
 28    than fifty thousand dollars ($50,000), or by both such imprisonment and fine.

  2        On page 1 of the  printed  bill,  in  line  16,  following  "any"  insert:
  3    "fire,";  also  in  line 16, delete "biological or" and insert: "biological,";
  4    and also in line 16, following "chemical" insert: "or  radioactive";  in  line
  5    20,  delete  "biological  or"  and insert: "biological,"; and also in line 20,
  6    following "chemical" insert: "or radioactive"; in line  21,  delete  "stances"
  7    and  insert:  "stance";  in  line  24,  delete  "biological  or"  and  insert:
  8    "biological,";  and also in line 24, following "chemical" insert: "or radioac-
  9    tive".
                                                                        
 10                                AMENDMENT TO THE BILL
 11        On page 1, following line 28, insert:
 12        "SECTION 3.  An emergency existing therefor,  which  emergency  is  hereby
 13    declared to exist, this act shall be in full force and effect on and after its

 15                                 CORRECTION TO TITLE
 16        On  page  1, in line 6, following "PUNISHMENT" insert: "; AND DECLARING AN
 17    EMERGENCY".

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

This legislation repeals the existing Idaho Code ยง 18
-3313, and enacts a new statute providing for the punishment 
of threats, false reports and hoaxes. It will make it a felony 
to willfully make a threat, or maliciously convey false 
information, concerning the presence of explosives or harmful 
substances, or an attempt to kill, injure or intimidate any 
person, or unlawfully damage or destroy any property, by means 
of fire, explosion or harmful substances. It would also make it 
a felony to maliciously place any device or substance in a 
location with the intent to induce a belief that the device or 
substance is an explosive or a harmful substance.




                          FISCAL IMPACT

There is no fiscal impact to the general fund.
