  1                                        AN ACT
  2    RELATING TO INSPECTION AND SUPPRESSION OF DISEASES AMONG  LIVESTOCK;  AMENDING
  3        CHAPTER 2, TITLE 25, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 25-212A,
  4        IDAHO CODE, TO PROVIDE FOR DEFICIENCY WARRANTS FOR DISEASE CONTROL.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That  Chapter  2,  Title  25, Idaho Code, be, and the same is
  7    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
  8    ignated as Section 25-212A, Idaho Code, and to read as follows:
                                                                        
  9        25-212A.  DEFICIENCY  WARRANTS  FOR DISEASE CONTROL. Whenever the director
 10    declares an emergency, as provided in section 25-212, Idaho Code, the director
 11    shall cause the disease to be controlled and eradicated, using such  funds  as
 12    have  been  appropriated or may hereafter be made available for such purposes;
 13    provided, that whenever the cost of disease control  and  eradication  exceeds
 14    the  funds  appropriated  or  otherwise  available for that purpose, the state
 15    board of examiners may authorize the issuance of deficiency  warrants  against
 16    the  general  fund  for up to five million dollars ($5,000,000) in any one (1)
 17    year for such disease control and eradication. The director, in executing  the
 18    provisions of this chapter insofar as it relates to disease control and eradi-
 19    cation,  shall have the authority to cooperate with federal, state, county and
 20    municipal agencies and private citizens in  disease  control  and  eradication
 21    efforts;  provided, that the state funds shall only be used to pay the state's
 22    share of the cost of the disease control and eradication efforts. Disease con-
 23    trol and eradication costs may include costs for inspection, diagnosis of dis-
 24    ease, indemnity paid to owners for infected, exposed  or  disease  susceptible
 25    animals  purchased  and  destroyed  by order of the director, costs associated
 26    with burial or disposal of animal carcasses, and costs for cleaning and disin-
 27    fecting of infected premises. Such moneys as the state shall thus become  lia-
 28    ble  for shall be paid as a part of the expenses of the department of agricul-
 29    ture out of appropriations which shall be made by  the  legislature  for  that
 30    purpose.  In  all appropriations hereafter made for expenses of the department
 31    of agriculture, account shall be taken of and provision made for this item  of
 32    expense.

Statement of Purpose / Fiscal Impact


	             STATEMENT OF PURPOSE
                          RS 11789


The purpose of this proposed legislation is to authorize the Board 
of Examiners to issue deficiency warrants against the General Fund 
for up to five million dollars ($5,000,000). The Board of Examiners 
may authorize the issuance of warrants only after the Director of 
Agriculture has declared an emergency regarding the outbreak of 
disease in Idaho’s livestock resources.


These monies may be used to cover the cost of inspection, diagnosis 
of disease, indemnity paid to owners of infected, exposed, or 
disease susceptible animals purchased and destroyed by order of 
the director, cost associated with burial or disposal of animal 
carcasses, and cost for cleaning and disinfecting of infected 
premises.


                      FISCAL IMPACT


A fiscal impact may occur to the General Fund only when an 
emergency is declared by the Director of Agriculture and the State 
Board of Examiners authorize the issuance of deficiency warrants.
