|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE BILL NO. 1381 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO FERTILIZERS; AMENDING CHAPTER 6, TITLE 22, IDAHO CODE, BY THE 3 ADDITION OF A NEW SECTION 22-607A, IDAHO CODE, TO PROVIDE FOR EDUCATIONAL 4 INFORMATION LABELING FOR FERTILIZERS. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Chapter 6, Title 22, Idaho Code, be, and the same is 7 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 8 ignated as Section 22-607A, Idaho Code, and to read as follows: 9 22-607A. EDUCATIONAL INFORMATION LABELING -- FERTILIZERS. (1) Beginning 10 January 1, 2003, any manufacturer, wholesaler or retailer within the state of 11 Idaho, whose sales include the sale of fertilizer, shall attach to any package 12 or container of fertilizer weighing less than one hundred (100) pounds, an 13 educational information label developed by the department of agriculture and 14 provided to manufacturers, wholesalers and retailers at department expense. 15 (2) Only one (1) label shall be required per package or container of fer- 16 tilizer. In the event a label has already been attached prior to purchase by a 17 wholesaler or retailer, the wholesaler or retailer shall not be required to 18 attach an additional label. 19 (3) The educational information label shall be of sufficient size to be 20 readily noticed and shall set forth educational information regarding the 21 proper handling of fertilizer and the hazards related to overapplication of 22 fertilizer as it relates to ground water and ground water quality. 23 (4) Manufacturers, wholesalers and retailers shall attach labels to pack- 24 ages and containers of fertilizer pursuant to the provisions of this section 25 without charge to purchasers of the fertilizer. 26 (5) The department is authorized to promulgate rules establishing a uni- 27 form label to be supplied and distributed to manufacturers, wholesalers and 28 retailers which shall, in part, designate label size and the specific fertil- 29 izer educational information to be included on the labels.
STATEMENT OF PURPOSE RS 11831 In some areas of the state nitrate levels are increasing in groundwater. One contributor to this growing problem is commercial fertilizers applied to residential and commercial landscapes. This proposal is intended to begin the educational process for such users, so they will understand the consequences of over application. It will require labeling with appropriate educational information developed by the Idaho Department of Agriculture for all packaged commercial fertilizers in containers under 100 pounds. FISCAL IMPACT The Department of Agriculture will incur the costs of developing the label which must be applied to packaged fertilizers. There may be some other incidental administrative costs.
