inviting bids for a highway district shall be published at least twice,
either not less than one week apart, or in five daily issues in a newspaper
of general circulation printed and published in the county or, if there is

  1                                        AN ACT
  2    RELATING TO PUBLICATION OF NOTICE  FOR  HIGHWAY  DISTRICTS;  AMENDING  SECTION
  3        40-907,  IDAHO  CODE, TO PROVIDE THAT AN ADVERTISEMENT INVITING BIDS SHALL
  4        BE PUBLISHED AT LEAST TWICE, EITHER NOT LESS THAN ONE WEEK  APART,  OR  IN
  5        FIVE  DAILY  ISSUES IN A NEWSPAPER OF GENERAL CIRCULATION PRINTED AND PUB-
  6        LISHED IN THE COUNTY OR, IF THERE IS NONE, IN A NEWSPAPER  HAVING  GENERAL
  7        CIRCULATION IN THE DISTRICT.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That  Section  40-907, Idaho Code, be, and the same is hereby
 10    amended to read as follows:
                                                                        
 11        40-907.  PUBLICATION OF NOTICE -- DOCUMENTS  TO  BE  MADE  AVAILABLE.  The
 12    advertisement  inviting  bids shall set a date, time and place for the opening
 13    of bids. The first publication of the advertisement inviting bids shall be  at
 14    least  two  (2)  weeks  before the date of opening the bids. The advertisement
 15    inviting bids shall be published at least twice, either not less than one  (1)
 16    week apart, or in five (5) daily issues, in a newspaper of general circulation
 17    printed  and  published  in  the county, or if there is none, it shall be pub-
 18    lished in a newspaper having general circulation in the district.  The  adver-
 19    tisement  inviting  bids  shall  succinctly  set forth the scope of work to be
 20    done. The following documents shall be made available by the county or highway
 21    district commissioners to any interested bidder: bid form,  bidder's  instruc-
 22    tions, contract documents with general and special instructions when appropri-
 23    ate, and drawings and specifications when appropriate.

                      STATEMENT OF PURPOSE	

                           RS 11952


Allows highway districts the ability to utilize the shorter 
advertising time period that the Idaho Department of Transportation 
has in l.C. §40-902. In some cases, the shorter time period may 
determine whether or not a project can be. completed in the 
construction season. Already allowed by l.C. §40-902 on behalf of 
Idaho Department of Transportation.

None to General Fund.
