  1                                        AN ACT
  2    RELATING TO THE IDAHO SCHOOL FOR THE DEAF AND THE BLIND; AMENDING CHAPTER  34,
  3        TITLE  33,  IDAHO  CODE,  BY  THE ADDITION OF A NEW SECTION 33-3409, IDAHO
  4        CODE, TO PROVIDE FOR A GENERAL FUND CONTINGENCY RESERVE; AND DECLARING  AN
  5        EMERGENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Chapter  34,  Title 33, Idaho Code, be, and the same is
  8    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
  9    ignated as Section 33-3409, Idaho Code, and to read as follows:
                                                                        
 10        33-3409.  GENERAL  FUND  CONTINGENCY RESERVE. The board of trustees of the
 11    Idaho school for the deaf and the blind may create  and  establish  a  general
 12    fund  contingency  reserve within the annual Idaho school for the deaf and the
 13    blind budget. Such general fund contingency reserve shall not exceed five per-
 14    cent (5%) of the total general fund appropriation to the Idaho school for  the
 15    deaf and the blind. Disbursements from this continuously appropriated fund may
 16    be  made  as the board of trustees determines necessary for contingencies that
 17    may arise. The balance of the contingency fund may be accumulated  beyond  the
 18    budgeted  fiscal year, but shall never exceed five percent (5%) of the current
 19    year's appropriation to the Idaho school for the deaf and the blind.
                                                                        
 20        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 21    declared to exist, this act shall be in full force and effect on and after its
 22    passage and approval.

Statement of Purpose / Fiscal Impact


	         STATEMENT OF PURPOSE		
                       RS 12014


Thiss legislation allows the State Board of Education, serving as 
the Board of Trustees for the Idaho School for the Deaf and the 
Blind (ISDE), to create and establish a general fund contingency 
reserve. Currently, Idaho Code provides that all Idaho school 
districts are allowed to create such a fund. The Idaho School for 
the Deaf and the Blind serves as the public school for children 
from birth to age 21 who are unable to be educated in local 
public schools because of their hearing or vision disability. In 
this capacity, the school maintains multiple buildings, several 
of which serve as residences for students attending the school. A 
contingency fund would greatly enhance the school’s ability to 
manage its business affairs and to meet unforeseen financial needs, 
especially when faced with unexpected building repairs or other 
such circumstances.
