|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE BILL NO. 1432 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO REQUIREMENTS FOR MAINTENANCE OF SCHOOL BUILDINGS; AMENDING CHAPTER 3 10, TITLE 33, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 33-1018, IDAHO 4 CODE, TO REQUIRE AN ALLOCATION BY SCHOOL DISTRICTS FOR BUILDING MAINTE- 5 NANCE, TO CREATE A FUND AND GOVERN USES OF THE FUND; AND PROVIDING AN 6 EFFECTIVE DATE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 10, Title 33, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 10 ignated as Section 33-1018, Idaho Code, and to read as follows: 11 33-1018. ALLOCATION FOR BUILDING MAINTENANCE REQUIRED. School districts 12 shall annually deposit funds from any source available to the district equal 13 to at least one and one-half percent (1.5%) of the replacement value of all 14 district owned buildings occupied by students to a deferred maintenance fund. 15 Moneys in a school district's deferred maintenance fund shall be used exclu- 16 sively for the maintenance and repair of the district owned buildings and 17 building systems that are occupied by students, the expenditures of which are 18 categorized as maintenance of buildings and equipment on forms prescribed by 19 the state department of education. Unexpended moneys in a school district's 20 deferred maintenance fund shall be carried over from year to year. The 21 replacement value of all district owned buildings that are occupied by stu- 22 dents shall be determined by multiplying the number of square feet of building 23 floor space in all district owned buildings that are occupied by students by 24 seventy-three dollars and twenty-five cents ($73.25). The joint finance- 25 appropriations committee shall annually review the replacement value per 26 square foot when setting appropriations for the educational support program, 27 and may make adjustments of this figure as necessary. School districts shall 28 annually submit the following to the state department of education: 29 (1) An update of the number of square feet of building floor space in 30 district owned buildings occupied by students; 31 (2) A report showing the funds and fund sources deposited into the 32 district's deferred maintenance fund in each fiscal year, the fund balance 33 carried forward from the prior fiscal years, and the amount and categories of 34 expenditures from the fund. 35 SECTION 2. This act shall be in full force and effect on and after July 36 1, 2003.
STATEMENT OF PURPOSE RS 12056 The Purpose of this legislation is to require school districts to spend or deposit in an account, specific funds calculated by formula for the purpose of maintaining occupied school district owned buildings.
