|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE BILL NO. 1436 BY RESOURCES AND ENVIRONMENT COMMITTEE 1 AN ACT 2 RELATING TO THE OFF-ROAD MOTOR VEHICLE ACCOUNT; AMENDING SECTION 57-1901, 3 IDAHO CODE, TO PROVIDE A CONDITION OF ELIGIBILITY FOR CERTAIN GRANT FUNDS. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 57-1901, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 57-1901. CREATION OF OFF-ROAD MOTOR VEHICLE ACCOUNT -- PURPOSE. There is 8 hereby created and established in the state treasury an account to be known as 9 the "off-road motor vehicle account" to which shall be credited or deposited 10 all moneys accruing for the purposes of the account. The purposes for which 11 moneys in the account may be used shall be to acquire, purchase, improve, 12 repair, maintain, furnish, and equip off-road motor vehicle facilities and 13 sites or areas used by off-road vehicles on public or private land, and to 14 assist with the enforcement of laws and regulations governing the use of off- 15 road vehicles in the state of Idaho. The park and recreation board is charged 16 with the administration of the account for the purposes specified herein. Pro- 17 vided however, that in order to be eligible for any grant for off-highway 18 vehicle programs funded by the "off-road motor vehicle account," an applicant 19 must have in place an adequate regulatory program, as determined by the direc- 20 tor and the park and recreation board pursuant to guidelines established by 21 rule, to ensure that natural resources are not damaged by intended use of the 22 area for which the grant is being obtained. The provisions of section 67-4228, 23 Idaho Code, are made applicable for the provisions of this section. All claims 24 against the account shall be examined, audited and allowed in the same manner 25 now or hereafter provided by law for claims against the state, except that the 26 board is hereby empowered to enter into agreements with legal governmental 27 agencies in Idaho, for the disbursement of funds to them on a project by proj- 28 ect basis.
STATEMENT OF PURPOSE RS 11905 As use and horsepower of off-road vehicles increases, reports of erosion and other resource damage are increasing. This proposal is intended to insure that recipients of off-road vehicle grants from the Department of Parks and Recreation have adequate regulatory programs in place to minimize such damage.
