MOTOR VEHICLES - INSURANCE - Amends existing law relating to casualty
insurance contracts for insured motor vehicle operators who are sixty-five
years of age or older to remove the restriction that there shall be no
reduction in premiums for completion of a self-instructed motor vehicle

  1                                        AN ACT
  2    RELATING TO CASUALTY INSURANCE CONTRACTS AND DISCOUNT FOR CERTAIN AGE  GROUPS;
  3        AMENDING SECTION 41-2515, IDAHO CODE, TO REMOVE THE RESTRICTION THAT THERE
  4        SHALL  BE  NO  REDUCTION  IN  PREMIUMS FOR COMPLETION OF A SELF-INSTRUCTED
  5        MOTOR VEHICLE ACCIDENT PREVENTION COURSE OR ANY SUCH COURSE WHICH DOES NOT
  6        PROVIDE FOR ACTUAL CLASSROOM OR  FIELD  DRIVING  INSTRUCTION,  TO  PROVIDE
  7        PROPER TERMINOLOGY AND TO MAKE A TECHNICAL CORRECTION.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That  Section 41-2515, Idaho Code, be, and the same is hereby
 10    amended to read as follows:
                                                                        
 11        41-2515.  DISCOUNT FOR CERTAIN AGE GROUPS. (1) Any  insurer  offering  for
 12    sale an automobile insurance policy, as policy is defined in subsection (a) of
 13    section  41-2506,  Idaho  Code, in which there is insured a principal operator
 14    who is sixty-five (65) years of age or older, shall provide for an appropriate
 15    reduction in premium charges for liability,  medical  payments  and  collision
 16    coverages  if the principal operator sixty-five (65) years of age or older has
 17    successfully completed a motor vehicle accident prevention course which  meets
 18    criteria established by the motor vehicle bureau of the transportation depart-
 19    ment.  However,  there  shall  be no reduction in premiums for completion of a
 20    self-instructed course or a course which does not provide for actual classroom
 21    or field driving instruction. Any discount used by an insurer  shall  be  pre-
 22    sumed appropriate unless credible evidence data demonstrates otherwise.
 23        (2)  Upon successful completion of an approved motor vehicle accident pre-
 24    vention  course,  each participant shall be issued, by the course's sponsoring
 25    entity, a certificate of completion which shall be the basis of the qualifica-
 26    tion for the discount on the automobile insurance.
 27        (3)  The premium reduction required in this section shall be effective for
 28    an insured for a three (3) year period  after  successful  completion  of  the
 29    approved  course,  except that the insurer may require, as a condition of pro-
 30    viding and maintaining the discount, that the insured for  a  three  (3)  year
 31    period  after  course completion, not be involved in an accident for which the
 32    insured is at fault or be found guilty of a moving traffic violation.
 33        (4)  The provisions of this section shall  not  apply  in  the  event  the
 34    approved course is specified by a court or other governmental entity resulting
 35    from a moving traffic violation.
 36        (5)  Each  participant shall take an approved course every three (3) years
 37    to continue to be eligible for the reduction in premiums.
 38        (6)  Nothing in the provisions of this section shall be deemed to prohibit
 39    an insurer from canceling or not renewing an automobile insurance  policy  for
 40    grounds enumerated in section 41-2507, Idaho Code, or in chapter 25, title 41,
 41    Idaho Code.
 42        (7)  The provisions of this section shall not apply in the event that such
 43    an insurer offers a premium reduction which is substantially comparable to the

  1    premium  reduction required in this section and in no event shall such insurer
  2    be required to provide both comparable  premium  reductions  on  a  cumulative
  3    basis.

Statement of Purpose / Fiscal Impact


                     STATEMENT OF PURPOSE
                          RS 11822

The purpose of this change is to allow drivers statewide access 
to motor vehicle accident prevention courses, and open the 
potential for alternatives to classroom or field driving 
instruction, such as on-line courses, as approved by the Idaho 
Transportation Department’s Division of Motor Vehicles. Use of 
alternative delivery methods (ADM) for training, will offer access 
and convenience to drivers in remote locations and provide 
opportunities to enhance and promote knowledge of safer driving 
practices along with the added benefit of reduction in premiums 
for those that qualify.
