1 AN ACT
2 APPROPRIATING MONEYS TO THE ATTORNEY GENERAL FOR FISCAL YEAR 2003; EXPRESSING
3 LEGISLATIVE INTENT WITH RESPECT TO CERTAIN EXPENDITURES; LIMITING THE NUM-
4 BER OF AUTHORIZED FULL-TIME EQUIVALENT POSITIONS; AND EXPRESSING LEGISLA-
5 TIVE INTENT WITH REGARD TO THE SPECIAL LITIGATION PROGRAM.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. There is hereby appropriated to the Attorney General the fol-
8 lowing amounts to be expended for the designated programs according to the
9 designated expense classes from the listed funds for the period July 1, 2002,
10 through June 30, 2003:

26 SECTION 2. It is legislative intent that an amount, not to exceed $1,000,
27 of the amount appropriated in Section 1 of this act, may be used at the dis-
28 cretion of the Attorney General to assist in defraying expenses relating to or
29 resulting from the discharge of the Attorney General's official duties. Such
30 moneys shall be accounted for according to the provisions of Chapter 36, Title
31 67, Idaho Code, and Section 67-3516, Idaho Code.
32 SECTION 3. In accordance with Section 67-3519, Idaho Code, the Attorney
33 General is authorized no more than one hundred eighty-three and fifteen-
34 hundredths (183.15) full-time equivalent positions at any point during the
35 period July 1, 2002, through June 30, 2003, for the programs specified in Sec-
36 tion 1 of this act, unless specifically authorized by the Governor. The Joint
37 Finance-Appropriations Committee will be notified promptly of any increased
38 positions so authorized.
39 SECTION 4. Notwithstanding the provisions of Section 67-3521, Idaho Code,
40 it is legislative intent that General Fund moneys appropriated and reappropri-

1 ated in the Special Litigation Program for fiscal year 2002 shall be deemed
2 encumbered if on or before June 30, 2002, the Attorney General certifies to
3 the Division of Financial Management that such funds are necessary to repre-
4 sent the state of Idaho in ongoing active natural resource litigation. In the
5 event revenue is insufficient to satisfy encumbrances, the Board of Examiners
6 is authorized to satisfy these encumbrances from other available sources.
