|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 126 BY AGRICULTURAL AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE IDAHO 3 DEPARTMENT OF AGRICULTURE RELATING TO GOVERNING ANIMAL INDUSTRY. 4 Be It Resolved by the Legislature of the State of Idaho: 5 WHEREAS, the Legislature is vested with authority to reject executive 6 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 7 that the Legislature finds that the rules are not consistent with legislative 8 intent; and 9 WHEREAS, it is the finding of the Legislature that certain rules of the 10 Idaho Department of Agriculture relating to governing animal industry are not 11 consistent with legislative intent and should be rejected. 12 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 13 sion of the Fifty-sixth Idaho Legislature, the Senate and the House of Repre- 14 sentatives concurring therein, that IDAPA 02.04.03, Section 388, subsection 15 04.b, concerning duration of quarantine and IDAPA 02.04.03, Section 405, sub- 16 section 01, concerning penalty for violations, rules of the Idaho Department 17 of Agriculture relating to governing animal industry, adopted as pending rules 18 under Docket Number 02-0403-0001, be, and the same are hereby rejected and 19 declared null, void and of no force and effect.
STATEMENT OF PURPOSE RS 11934 This concurrent resolution would reject pending rules of the Idaho Department of Agriculture governing animal industry. The effect of this resolution, if adopted by both houses, would be to prevent the agency rule change from going into effect. FISCAL NOTE This concurrent resolution has no fiscal impact.
