  1                                        AN ACT
  2    RELATING TO THE PRACTICE OF DENTISTRY AND DENTAL HYGIENE;  REPEALING  SECTIONS
  3        54-901  AND  54-902, IDAHO CODE; AMENDING CHAPTER 9, TITLE 54, IDAHO CODE,
  4        BY THE ADDITION OF A  NEW SECTION 54-901, IDAHO CODE, TO DEFINE THE  PRAC-
  5        TICE  OF  DENTISTRY;  AND AMENDING CHAPTER 9, TITLE 54, IDAHO CODE, BY THE
  6        ADDITION OF A NEW SECTION 54-902, IDAHO CODE, TO DEFINE  THE  PRACTICE  OF
  7        DENTAL HYGIENE.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That Sections 54-901 and 54-902, Idaho Code, be, and the same
 10    are hereby repealed.
                                                                        
 11        SECTION 2.  That Chapter 9, Title 54, Idaho Code,  be,  and  the  same  is
 12    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 13    ignated as Section 54-901, Idaho Code, and to read as follows:
                                                                        
 14        54-901.  DEFINITION -- PRACTICE OF DENTISTRY. The practice of dentistry is
 15    defined as the evaluation, diagnosis, prevention and  treatment  (nonsurgical,
 16    surgical  or  related procedures) of diseases, disorders and conditions of the
 17    oral cavity, maxillofacial area and the adjacent and associated structures and
 18    their impact on the human body, within the scope of  the  person's  education,
 19    training  and  experience, in accordance with the ethics of the profession and
 20    applicable law.
                                                                        
 21        SECTION 3.  That Chapter 9, Title 54, Idaho Code,  be,  and  the  same  is
 22    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 23    ignated as Section 54-902, Idaho Code, and to read as follows:
                                                                        
 24        54-902.  DEFINITION -- PRACTICE OF DENTAL HYGIENE. The practice of  dental
 25    hygiene  is defined as the evaluation, prevention and nonsurgical treatment of
 26    diseases, disorders and conditions of the oral cavity, maxillofacial area  and
 27    the  adjacent  and  associated  structures and their impact on the human body,
 28    within the scope of the person's education, training and experience, in accor-
 29    dance with the ethics of the profession and applicable law.

                     STATEMENT OF PURPOSE

                             RS 11434

     The purpose of this proposed legislation is to update the 
definition of dentistry (54-901) and the practice of dental hygiene 
(54-902).  These definitions will reflect the current practice of 
dentistry and dental hygiene.
