SPEAKER Requested by: Department of Juvenile Corrections 1 AN ACT 2 RELATING TO MARKING OF STATE VEHICLES; AMENDING SECTION 49-2426, IDAHO CODE, 3 TO PROVIDE AN EXCEPTION FROM STATUTORY REQUIREMENTS REGARDING MARKING FOR 4 CERTAIN VEHICLES UNDER THE CUSTODY AND CONTROL OF THE DIRECTOR OF THE 5 IDAHO DEPARTMENT OF JUVENILE CORRECTIONS AND TO MAKE TECHNICAL CORREC- 6 TIONS. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 49-2426, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-2426. MARKING OF VEHICLES -- CERTAIN VEHICLES EXCEPTED. (1) Every 11 motor vehicle owned by or under control and custody of the state of Idaho, 12 except as provided in subsections (2) and (3) of this section, or in section 13 49-2427, Idaho Code, shall be indelibly and conspicuously lettered on each 14 side, in plain letters not less than one and one-half (1 1/2) inches high, 15 with the words "State of Idaho" or "Idaho" with the name of the proper depart- 16 ment, as defined in section 67-2402, Idaho Code, in each case inserted follow- 17 ing either of these words. The words shall be kept clear, distinct and visible 18 at all times. The provisions of this section shall not be applicable to any 19 motor vehicle in the personal service of the governor, except that upon the 20 front doors of any motor vehicle in his personal service there shall be placed 21 the Great Seal of the state of Idaho. 22 (2) Motor vehicles under the custody and control of the director of the 23 Idaho state police and used for confidential investigative purposes when nec- 24 essary to enforce the laws of this state or motor vehicles under the custody 25 and control of the director of the department of health and welfare and used 26 for official state business need not be marked as provided in subsection (1) 27aboveof this section. Any other department, agency, or entity of the state 28 shall apply in writing to the director for permission to use one (1) or more 29 unmarked vehicles for confidential investigative purposes. Permission shall be 30 granted only in writing and upon a finding of good cause. 31 (3) Motor vehicles under the custody and control of the director of the 32 Idaho department of juvenile corrections, when used for official state busi- 33 ness and to enforce laws of the juvenile corrections system, including inves- 34 tigation of juveniles under its purview, need not be marked as provided in 35 subsection (1) of this section.
STATEMENT OF PURPOSE RS 11427 The purpose of this proposal is to amend section 49-2426(2) to exempt the Department of Juvenile Corrections from having department identifying decals on the Department's cars. Employees have experienced negative behaviors from other drivers as well as pedestrians along with damage to cars, which we believe is directly linked to the car decal. FISCAL IMPACT The only impact to the general fund would be reprinting the statute--a normal expenditure. Car decals will be removed by Department employees. CONTACT Name: Brent D.
