  1                                        AN ACT
  2    RELATING TO ADMINISTRATION OF  THE  FOREST  PRACTICES  ACT;  AMENDING  SECTION
  3        38-134,  IDAHO  CODE,  TO  INCREASE  THE MAXIMUM ANNUAL ASSESSMENT FOR THE
  4        ADMINISTRATION AND ENFORCEMENT OF THE FOREST  PRACTICES  ACT  FOR  CERTAIN
  5        PRIVATE OWNERS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section  38-134, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        38-134.  FOREST PRACTICES ACT ADMINISTRATION -- FUNDING. The  director  of
 10    the department of lands is charged in section 38-1305, Idaho Code, to adminis-
 11    ter  and  enforce  the forest practices act on all private forest lands within
 12    the state. Funding for this activity shall come from an annual budget  request
 13    from  the  general  account  and from an annual assessment to be paid by every
 14    private owner of forest land in the state. The assessment for  private  owners
 15    of  forest  lands whose total acres of forest lands are twenty-five (25) acres
 16    or fewer shall be a sum of one dollar and twenty-five cents ($1.25),  and  for
 17    private  owners  of forest lands whose total acres of forest lands are twenty-
 18    six (26) acres or more, the assessment shall not exceed five ten cents  (510)
 19    an acre per year. The assessment shall be collected in the same fashion and at
 20    the same time as the forest protection assessment described in section 38-111,
 21    Idaho Code.

Statement of Purpose / Fiscal Impact

                        STATEMENT OF PURPOSE

                             RS 11439

The Idaho Forest Practices Act (Idaho Code Title 38, Chapter 13)  is 
designed to ensure that forest practices on state, private, and 
federal lands in Idaho are conducted so that site productivity and 
water quality are protected.  An important element is the Idaho 
Cumulative Watershed Effects program that is integral to TMDL 
development on water quality limited stream segments.   
The Forest Practices Act administration costs are paid from a 
combination of general funds, and forest landowner assessments. The 
cash balance in the Forest Practices Administration dedicated account 
has been depleted to the point that an increase in collections is 
needed. The proposed legislation amends Section 38- 134, Idaho Code, 
to increase the landowner assessment for forest protection from 
$0.05/acre to $.10/acre.  The forest landowner assessments are 
deposited into the Forest Practices Administration dedicated account.

                         FISCAL IMPACT

Revenues from forest landowner assessments will increase from about 
$210,000 to $420,000 per year.  These monies are deposited in the 
forest protection dedicated account and utilized to defray forest 
practices administration costs.
