  1                                        AN ACT
  2    RELATING TO CORONERS; AMENDING SECTION 31-2808, IDAHO CODE,  TO  PROVIDE  THAT
  3        CERTAIN  PROVISIONS RELATING TO THE FINAL DISPOSITION OF DEAD HUMAN BODIES
  4        SHALL NOT APPLY IN COUNTIES WHERE  THERE  IS  ONLY  ONE  LICENSED  FUNERAL
  5        ESTABLISHMENT.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section 31-2808, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        31-2808.  MAKING FINAL DISPOSITION OF DEAD  HUMAN  BODIES  PROHIBITED.  No
 10    coroner  or  person  acting as coroner who is a licensed funeral director or a
 11    licensed mortician, owner, proprietor or employee of any establishment engaged
 12    in making final disposition of dead human bodies, and  no  establishment  with
 13    which  such  coroner  or person acting as coroner is associated, shall, except
 14    for ambulance services, perform any of the services of a funeral  director  or
 15    mortician  or  furnish any materials connected with or incidental to the final
 16    disposition of the body of any person whose death is required  by  law  to  be
 17    investigated by such coroner or other person acting in that capacity. Any per-
 18    son who violates this section shall be guilty of a misdemeanor. Provided, how-
 19    ever,  that the provisions of this section shall not be applicable in counties
 20    wherein there resides is only one (1) licensed funeral  director  or  licensed
 21    mortician establishment.

This only changes the word "reside" to "is" and "director or licensed
mortician" to "establishment".
