|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 433 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO COUNTY CORONERS; AMENDING SECTIONS 31-5213, 31-5311, 31-5408, 3 31-5510 AND 31-5610, IDAHO CODE, TO PROVIDE THAT COUNTY CORONERS SHALL 4 COMPLETE AT LEAST EIGHT HOURS OF ANNUAL TRAINING IN CERTAIN SUBJECTS, TO 5 PROVIDE THAT FAILURE TO COMPLETE SUCH TRAINING SHALL BE GROUNDS FOR 6 REMOVAL FROM OFFICE AND TO MAKE TECHNICAL CORRECTIONS; AND AMENDING SEC- 7 TION 34-622, IDAHO CODE, TO REVISE QUALIFICATIONS FOR COUNTY CORONERS TO 8 INCLUDE CERTAIN TRAINING REQUIREMENTS AND TO PROVIDE THAT FAILURE TO COM- 9 PLETE SUCH TRAINING SHALL BE GROUNDS FOR REMOVAL FROM OFFICE. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. That Section 31-5213, Idaho Code, be, and the same is hereby 12 amended to read as follows: 13 31-5213. COUNTY CORONER. For purposes of thisactchapter the duties of 14 the county coroner shall be as provided in chapter 28, title 31, Idaho Code, 15 and as otherwise prescribed by law. A county coroner: 16 (1) Shall continue to be elected to a term of four (4) years and to per- 17 form all the duties and responsibilities of the office; or 18 (2) Shall be elected to a different term of office as provided in the 19 resolution or petition, but not to exceed four (4) years, and perform all the 20 duties of the office; or 21 (3) Shall be appointed by the executive with the advice and consent of 22 the board of county commissioners, be supervised by the executive and perform 23 all the duties of the office; provided however, that the county coroner shall 24 complete, annually, at least eight (8) hours of training in subjects includ- 25 ing, but not limited to, Idaho coroner law and death investigation procedures 26 and protocol. Failure to complete such training shall be grounds for removal 27 from office; or 28 (4) The office shall be eliminated as a separate office with the duties 29 and responsibilities of the office to be performed by one (1) or more other 30 qualified elected officers or appointed persons as provided in the resolution 31 or petition. The resolution or petition shall specifically identify those 32 duties of the office for which each other officer or appointee shall be 33 responsible. 34 SECTION 2. That Section 31-5311, Idaho Code, be, and the same is hereby 35 amended to read as follows: 36 31-5311. COUNTY CORONER. For purposes of thisactchapter the duties of 37 the county coroner shall be as provided in chapter 28, title 31, Idaho Code, 38 and as otherwise prescribed by law. A county coroner: 39 (1) Shall continue to be elected to a term of four (4) years and to per- 40 form all the duties and responsibilities of the office; or 41 (2) Shall be elected to a different term of office as provided in the 2 1 resolution or petition, but not to exceed four (4) years, and perform all the 2 duties of the office; or 3 (3) Shall be appointed by the manager with the advice and consent of the 4 board of county commissioners, be supervised by the manager and perform all 5 the duties of the office; provided however, that the county coroner shall com- 6 plete, annually, at least eight (8) hours of training in subjects including, 7 but not limited to, Idaho coroner law and death investigation procedures and 8 protocol. Failure to complete such training shall be grounds for removal from 9 office; or 10 (4) The office shall be eliminated with the duties and responsibilities 11 of the office to be performed by one (1) or more other elected officers or 12 appointed persons as provided in the resolution or petition. The resolution or 13 petition shall identify those duties of the office for which each other offi- 14 cer or appointee shall be responsible. 15 SECTION 3. That Section 31-5408, Idaho Code, be, and the same is hereby 16 amended to read as follows: 17 31-5408. COUNTY CORONER. For purposes of thisactchapter the duties of 18 the county coroner shall be as provided in chapter 28, title 31, Idaho Code, 19 and as otherwise prescribed by law. A county coroner: 20 (1) Shall continue to be elected to a term of four (4) years and to per- 21 form all the duties and responsibilities of the office; or 22 (2) Shall be elected to a different term of office as provided in the 23 resolution or petition, but not to exceed four (4) years, and perform all the 24 duties of the office; or 25 (3) Shall be appointed by the board of county commissioners and perform 26 all the duties of the office; provided however, that the county coroner shall 27 complete, annually, at least eight (8) hours of training in subjects includ- 28 ing, but not limited to, Idaho coroner law and death investigation procedures 29 and protocol. Failure to complete such training shall be grounds for removal 30 from office; or 31 (4) The office shall be eliminated with the duties and responsibilities 32 of the office to be performed by one (1) or more other elected officers or 33 appointed persons as provided in the resolution or petition. That Section 31-5510, Idaho Code, be, and the same is hereby 37 amended to read as follows: 38 31-5510. COUNTY CORONER. For purposes of thisactchapter the duties of 39 the county coroner shall be as provided in chapter 28, title 31, Idaho Code, 40 and as otherwise prescribed by law. A county coroner: 41 (1) Shall continue to be elected to a term of four (4) years and to per- 42 form all the duties and responsibilities of the office; or 43 (2) Shall be elected to a different term of office as provided in the 44 resolution or petition, but not to exceed four (4) years, and perform all the 45 duties of the office; or 46 (3) Shall be appointed by the board of county commissioners or the execu- 47 tive board with the advice and consent of the entire board of county commis- 48 sioners, be supervised by the entire board or the executive board, as applica- 49 ble, and perform all the duties of the office; provided however, that the 50 county coroner shall complete, annually, at least eight (8) hours of training 51 in subjects including, but not limited to, Idaho coroner law and death inves- 3 1 tigation procedures and protocol. Failure to complete such training shall be 2 grounds for removal from office; or 3 (4) The office shall be eliminated with the duties and responsibilities 4 of the office to be performed by one (1) or more other elected officers or 5 appointed persons as provided in the resolution or petition. The resolution 6 or petition shall identify those duties of the office for which each other 7 officer or appointee shall be responsible. 8 SECTION 5. That Section 31-5610, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 31-5610. COUNTY CORONER. For purposes of thisactchapter the duties of 11 the county coroner shall be as provided in chapter 28, title 31, Idaho Code, 12 and as otherwise prescribed by law. A county coroner: 13 (1) Shall continue to be elected to a term of four (4) years and to per- 14 form all the duties and responsibilities of the office; or 15 (2) Shall be elected to a different term of office as provided in the 16 resolution or petition, but not to exceed four (4) years, and perform all the 17 duties of the office; or 18 (3) Shall be appointed by the board of county commissioners or the execu- 19 tive board with the advice and consent of the entire board of county commis- 20 sioners, be supervised by the entire board or the executive board, as applica- 21 ble, and perform all the duties of the office; provided however, that the 22 county coroner shall complete, annually, at least eight (8) hours of training 23 in subjects including, but not limited to, Idaho coroner law and death inves- 24 tigation procedures and protocol. That Section 34-622, Idaho Code, be, and the same is hereby 32 amended to read as follows: 33 34-622. ELECTION OF COUNTY CORONERS -- QUALIFICATIONS. (1) At the general 34 election, 1986, and every four (4) years thereafter, a coroner shall be 35 elected in every county. 36 (2) No person shall be elected to the office of coroner unless he: 37 (a) Hhas attained the age of twenty-one (21) years at the time of his 38 election,; 39 (b) Iis a citizen of the United States;and40 (c) Sshall have resided within the county one (1) year next preceding his 41 election; and 42 (d) Agrees to complete, on an annual basis, at least eight (8) hours of 43 training in subjects including, but not limited to, Idaho coroner law and 44 death investigation procedures and protocol. Failure to complete such 45 training shall be grounds for removal from office. 46 (3) Each candidate shall file his declaration of candidacy with the 47 county clerk. 48 (4) Each candidate who files a declaration of candidacy shall at the same 49 time pay a filing fee of forty dollars ($40.00) which shall be deposited in 50 the county treasury.
