|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 478 BY TRAIL 1 AN ACT 2 RELATING TO UNIVERSITY DEBIT CARDS; AMENDING SECTION 26-3002, IDAHO CODE, TO 3 REVISE DEFINITIONS AND TO INCLUDE REFERENCES TO CONTRACTED THIRD PARTY 4 PROGRAM PROVIDERS; AND AMENDING SECTION 26-3003, IDAHO CODE, TO PROVIDE 5 THAT DEBIT CARD TRANSACTIONS MAY BE USED TO PURCHASE GOODS OR SERVICES 6 FROM APPROVED VENDORS LOCATED AT ANY COLLEGE OR UNIVERSITY SITE OR IN THE 7 COMMUNITY IN WHICH THE COLLEGE OR UNIVERSITY IS LOCATED. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 26-3002, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 26-3002. DEFINITIONS. As used in this chapter and unless the context 12 otherwise requires: 13 (1) "Debit card transaction" means the purchase of either goods or ser- 14 vices, or both, whereby payment is made through the means of a point of sale 15 or other payment system maintained by the college,oruniversity or contracted 16 third party program provider which results in a charge to a credit balance 17 maintained by a registered student or a member of its faculty or staff with 18 the college,oruniversitybusiness officeor contracted third party program 19 provider. 20 (2) "University debit card" means a card issued by a college or univer- 21 sity located in this state to a registered student or a member of its faculty 22 or staff which permits such persons to draw against funds on deposit with the 23 college,oruniversitybusiness officeor contracted third party provider for 24 the purchase of goods or services. 25 (3) "University debit card program" means a financial arrangement whereby 26 a college or university allows a registered student or a member of its faculty 27 or staff to place funds on deposit with the college,oruniversitybusiness28officeor contracted third party provider against which such persons may draw, 29 through a debit card transaction, for the purchase of either goods or services 30 or both. 31 SECTION 2. That Section 26-3003, Idaho Code, be, and the same is hereby 32 amended to read as follows: 33 26-3003. DEBIT CARD AUTHORITY AND BOND. (1) Any college or university 34 located in Idaho may make available to its student body and to members of its 35 faculty and staff a university debit card program. A debit card transaction 36 may be usedonlyto purchase goods or services from the college or university 37 orthrough itsapproved vendors locatedon the principal campus of theat any 38 college or university, which goods or services traditionally are provided by a39college or university to its students, faculty or staffsite or in the commu- 40 nity in which the college or university is located. 41 (2) A surety bond in a form approved by the governing authority of the 2 1 college or university in the amount of ten thousand dollars ($10,000) shall be 2 maintained for each employee of the college or university with access to the 3 funds maintained in the university debit card program.
STATEMENT OF PURPOSE RS 11480 The intent of this legislation is that any college or university located in Idaho may make available to its student body and members of its faculty and staff a university debit card program. A debit card transaction may be used to purchase goods or services from the college or university or approved vendors located at any college or university site or in the community in which the college or university is located. A surety bond in a form approved by the governing authority of the college or university in the amount of ten thousand dollars (10,000) shall be maintained for each employee of the college or university with access to the funds maintained in the university debit card program.
