That Section 67-1802, Idaho Code, be, and the same is hereby 17 amended to read as follows: 18 67-1802. IDAHO MILLENNIUM INCOME FUND. There is hereby created in the 19 state treasury the "Idaho Millennium Income Fund." The fund shall consist of 20 distributions from the Idaho millennium fund and such moneys that may be pro- 21 vided by legislative appropriations. The Idaho millennium income fund shall be 22 managed by the state treasurer and shall retain its own earnings. The uses of 23 this fund shall be determined by legislative appropriation, provided that such 24 appropriations may only be granted on a one-time basis.through June 30, 2004,25excepting any appropriations to pay the administrative costs of managing the26Idaho millennium fund and the Idaho millennium income fund.27 SECTION 2. That Chapter 18, Title 67, Idaho Code, be, and the same is 28 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 29 ignated as Section 67-1804, Idaho Code, and to read as follows: 30 67-1804. JOINT MILLENNIUM FUND COMMITTEE -- CREATION AND APPOINTMENT OF 31 MEMBERS. There is hereby created the joint millennium fund committee, hereaf- 32 ter referred to as the committee. The committee shall consist of ten (10) mem- 33 bers, each of whom shall be a member of the legislature. The committee members 34 shall be appointed as follows: three (3) members shall be appointed by the 35 president pro tempore of the senate, one (1) of whom shall be cochair of the 36 committee; two (2) members shall be appointed by the minority leader of the 37 senate; three (3) members shall be appointed by the speaker of the house of 38 representatives, one (1) of whom shall be cochair of the committee; and two 39 (2) members shall be appointed by the minority leader of the house of repre- 40 sentatives. The term of a member of the committee shall coincide with the term 41 of election to the legislature. A vacancy during the term of a member of the 2 1 committee shall be filled by the appointing authority of that member, and mem- 2 bers may be reappointed to a subsequent term. 3 SECTION 3. That Chapter 18, Title 67, Idaho Code, be, and the same is 4 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 5 ignated as Section 67-1805, Idaho Code, and to read as follows: 6 67-1805. POWERS AND DUTIES OF THE COMMITTEE. The committee shall have the 7 following powers and duties: 8 (1) To meet not less than two (2) times each year; 9 (2) To establish rules for governance and operation of committee proceed- 10 ings; 11 (3) To request applications for funding from the Idaho millennium income 12 fund; 13 (4) To meet to hear testimony and to consider applications for funding 14 from the Idaho millennium income fund; 15 (5) To evaluate the actual and potential success of programs funded with 16 moneys from the Idaho millennium income fund; and 17 (6) To present recommendations annually to the legislature for the use of 18 the moneys in the Idaho millennium income fund. 19 SECTION 4. That Chapter 18, Title 67, Idaho Code, be, and the same is 20 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 21 ignated as Section 67-1806, Idaho Code, and to read as follows: 22 67-1806. SUPPORT AND STAFF FOR THE COMMITTEE. The legislative services 23 office shall provide for the support and staffing of the committee as the com- 24 mittee may require in the performance of its duties. 25 SECTION 5. That Chapter 18, Title 67, Idaho Code, be, and the same is 26 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 27 ignated as Section 67-1807, Idaho Code, and to read as follows: 28 67-1807. LIMITATION ON USES OF IDAHO MILLENNIUM INCOME FUND. The commit- 29 tee shall consider only applications for programs and projects directly 30 related to one (1) or more of the following: 31 (1) Tobacco cessation or prevention; 32 (2) Substance abuse cessation or prevention; or 33 (3) Tobacco or substance abuse related disease treatment. 34 SECTION 6. This act shall be in full force and effect on and after July 35 1, 2002, provided that the initial appointments authorized in Section 2 of 36 this act may be made prior to the effective date of this act.

STATEMENT OF PURPOSE RS 11643 The purpose of this legislation is to amend Idaho Code 67-1802, the Idaho Millennium Income Fund. This amendment will remove the sunset clause, add new sections creating the size of the committee, its duties and powers, and specifying limitations on uses of the Idaho Millennium Income Fund.
