|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 511 BY APPROPRIATIONS COMMITTEE 1 AN ACT 2 APPROPRIATING ADDITIONAL MONEYS TO THE ATTORNEY GENERAL FOR FISCAL YEAR 2002; 3 EXPRESSING LEGISLATIVE INTENT TO DIRECT A PORTION OF WORKER'S COMPENSATION 4 DIVIDENDS TO STATE AGENCIES TO THE GENERAL FUND; AND DECLARING AN EMER- 5 GENCY. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. In addition to the appropriation made in Section 1, Chapter 8 228, Laws of 2001, there is hereby appropriated to the Attorney General the 9 following amount to be expended for the Special Litigation program according 10 to the designated expense class from the listed fund for the period July 1, 11 2001, through June 30, 2002: 12 FOR: 13 Operating Expenditures $336,200 14 FROM: 15 General Fund $336,200 16 SECTION 2. It shall be the intent of the Legislature that of the total 17 remitted to state agencies as policyholders in the form of a dividend from the 18 State Insurance Fund, $336,200 shall be requested by the state of Idaho to be 19 paid immediately and deposited with the Office of the State Treasurer to the 20 General Fund. A written request on behalf of the state of Idaho shall be com- 21 municated to the Manager of the State Insurance Fund by the Chairmen of the 22 Joint Finance-Appropriations Committee upon passage of this act. The balance 23 of the dividends shall be credited to each individual agency proportionally in 24 accordance with Section 72-915, Idaho Code, as determined by the State Insur- 25 ance Fund, and reported to the Office of the State Controller for a reduction 26 in payroll costs during calendar year 2002. 27 SECTION 3. An emergency existing therefor, which emergency is hereby 28 declared to exist, this act shall be in full force and effect on and after its 29 passage and approval.

This is a FY 2002 Supplemental Appropriation to the Office of the Attorney General for the Special Litigation Program.

This bill appropriates an additional $336,200 from the General Fund to the Special Litigation Program to restore the funding used to defend the state’s interests in the lawsuit Hayden Lake Fire District vs. the State Insurance Fund. The original lawsuit was a class action lawsuit for which the Governor determined it was in the state’s best interest to obtain legal representation and officially side with the plaintiff (State Insurance Fund). Outside legal representation was necessary because the State Insurance Fund was already represented by the Office of the Attorney General.
The funding mechanism in this bill requests the State Insurance Fund to adjust the dividends that state agencies would normally receive in calendar year 2002 to pay for this defense, and leave the remaining credit to reduce personnel costs during the calendar year. Agencies are fully funded for workers’ compensation premiums, and dividends reduce those costs without a corresponding reduction in appropriations.
