  1                                        AN ACT
  2    RELATING TO PUBLIC CHARTER SCHOOLS; AMENDING SECTION 33-5210, IDAHO  CODE,  TO
  3        CLARIFY  THAT CHARTER SCHOOLS ARE REQUIRED TO COMPLY WITH THE GENERAL EDU-
  4        CATION LAWS OF THE STATE UNLESS SPECIFICALLY DIRECTED OTHERWISE IN  PUBLIC
  5        CHARTER SCHOOL LAW.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section 33-5210, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        33-5210.  APPLICATION OF SCHOOL LAW -- ACCOUNTABILITY  --  EXEMPTION  FROM
 10    STATE  RULES. (1) All public charter schools are under the general supervision
 11    of the state board of education.
 12        (2)  The local board of trustees and the  state  board  of  education  are
 13    responsible  to  ensure  that each charter school program approved by it meets
 14    the terms of the charter, complies with the  general  education  laws  of  the
 15    state  unless  specifically  directed  otherwise in this chapter 52, title 33,
 16    Idaho Code, and operates in accordance with the state educational standards of
 17    thoroughness as defined in section 33-1612, Idaho Code.
 18        (3)  Each charter school is otherwise exempt from rules  governing  school
 19    districts  which  have  been promulgated by the state board of education or by
 20    the superintendent of public instruction, with the exception  of  state  rules
 21    relating to:
 22        (a)  Waiver  of teacher certification as necessitated by the provisions of
 23        section 33-5205(3)(g), Idaho Code;
 24        (b)  Accreditation of the school as necessitated by the provisions of sec-
 25        tion 33-5205(3)(e), Idaho Code;
 26        (c)  Qualifications of a student for attendance at an  alternative  school
 27        as necessitated by the provisions of section 33-5208(3), Idaho Code; and
 28        (d)  The  requirement  that all employees of the school undergo a criminal
 29        history check as required by section 33-130, Idaho Code.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                            RS 11770

This legislation makes clear that all sections of Title 33 do
apply to charter schools, unless specifically waived in Chapter
52 of Idaho Code. In Idaho Code 33-5210, charter schools are
exempt from rules governing school districts, which have been
promulgated by the State Board of Education by the Superintendent
of Public Education, with some noted exceptions. Often people
opening new charter schools do not know the difference between
State Rules and Idaho Code.

                          FISCAL IMPACT

There will be no impact on the state budget or appropriation to
public schools.
