2 RELATING TO POWERS AND DUTIES OF THE STATE BOARD OF EDUCATION; AMENDING CHAP-
3 TER 1, TITLE 33, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 33-131,
4 IDAHO CODE, TO SPECIFY DUTIES OF THE STATE BOARD OF EDUCATION TO FURTHER
5 GOALS OF EQUITY FUNDING OF PUBLIC INSTITUTIONS OF HIGHER EDUCATION AND TO
6 REQUIRE REPORTS TO THE LEGISLATURE.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Chapter 1, Title 33, Idaho Code, be, and the same is
9 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
10 ignated as Section 33-131, Idaho Code, and to read as follows:
11 33-131. EQUITY FUNDING. In furtherance of the duties of the state board
12 of education relating to the management of the public institutions of higher
13 education of the state of Idaho, an equity funding study was completed and
14 reported to the board and the legislature in 2002. It will be important for
15 the future of equity funding that implementation of the study recommendation,
16 adopted by the board, be reviewed on a regular basis. The state board of edu-
17 cation shall regularly assess the progress toward equitable funding, and shall
18 report to the education committees of the senate and house of representatives
19 in the first regular session of each legislature. Ten (10) years from the
20 report of 2002, and each ten (10) years thereafter, the state board of educa-
21 tion shall commission a complete equity funding study and report the findings
22 to the legislature.
STATEMENT OF PURPOSE
RS 11808
In 2001 stakeholders brought the issue of higher education
funding equity to the State Board of Education. Each year the
legislature appropriates a lump sum from the general fund for higher
education and the State Board of Education distributes that
appropriation to the various institutions. A formula is used for the
distribution of that lump sum appropriation. This funding formula
has been in existence and has remained basically unchanged for many
years.
In the summer of 2001 the board contracted with a national
educational consulting firm to assess the inequities inherent in the
funding formula and to make recommendations. Based upon those
recommendations the Board has now made significant changes to the
funding formula.
The purpose of this legislation is to add a statutory
requirements to the duties of the board to monitor the funding
formula for higher education in a systematic manner and to report
biennially to the germain legislative committees. Additionally, this
new statue would require the board to commission a complete funding
equity study every ten years.
FISCAL IMPACT
The adoption of this legislation would impact the general funds
of the state in a neutral fashion. JFAC will continue to recommend
a lump sum for higher education and the State Board of Education
will distribute that sum through the formula.
