  2    RELATING TO THE TEMPORARY INABILITY OF  A  FIRE  PROTECTION  DISTRICT  COMMIS-
  3        SIONER; AMENDING SECTION 31-1416A, IDAHO CODE, TO REQUIRE A SIGNED WRITTEN
  4        NOTICE FROM A COMMISSIONER WHO IS TEMPORARILY UNABLE TO PERFORM THE DUTIES
  5        OF  THE OFFICE OF A PERIOD OF AT LEAST NINETY DAYS AND TO PROVIDE FOR EACH
  6        MEMBER OF THE BOARD OF A FIRE PROTECTION DISTRICT TO DESIGNATE TWO  TEMPO-
  7        RARY INTERIM SUCCESSORS.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That Section 31-1416A, Idaho Code, be, and the same is hereby
 10    amended to read as follows:
                                                                        
 11        31-1416A.  TEMPORARY INABILITY OF COMMISSIONER. Whenever, for any  reason,
 12    any  member  of the board of fire protection district commissioners submits to
 13    the board a signed written notice stating that the commissioner is temporarily
 14    unable to perform the duties of the office for a period  of  at  least  ninety
 15    (90)  days,  the other members of the board shall appoint a suitable person to
 16    perform such duties temporarily as an acting officer as provided herein, until
 17    the incumbent of the office shall be able to resume  the  performance  of  his
 18    duties, or a vacancy occurs in such office.
 19        Each  member  of  the  board of a fire protection district shall designate
 20    three two (32) temporary interim successors to his powers and duties and spec-
 21    ify their order of succession. Each member shall  review  and,  as  necessary,
 22    revise  the designations of temporary interim successors so there are at least
 23    always two (2) qualified temporary interim successors. The  designation  of  a
 24    temporary  interim successor shall become effective when the member making the
 25    designation files with the secretary of the board of the fire protection  dis-
 26    trict the name, address and rank of the successors in order of succession.
 27        When  a  member  of the board of fire protection district commissioners is
 28    temporarily unable to perform the duties of office, the other members  of  the
 29    board  shall appoint a temporary interim successor highest in order of succes-
 30    sion who is available. The interim successor, except for the power and duty to
 31    appoint temporary interim successors, shall exercise the power and assume  the
 32    duties  of  the member of the board of fire protection district commissioners.
 33    No person shall be designated or serve as a temporary interim successor unless
 34    he is qualified to hold the office of a member of the board of fire protection
 35    district commissioners, to whose powers and duties he is designated to succeed
 36    under the constitution and laws of the state of Idaho. The order  of  appoint-
 37    ment  of  a temporary interim successor shall be recorded in the official pro-
 38    ceedings of the board.

                     STATEMENT OF PURPOSE
                        RS 11862

The purpose of this proposed amendment is to require that any member 
of the board of fire protection district commissioners who is 
temporarily unable to fulfill his or her duties, must submit a 
signed written notice to the board. In addition, each member of 
the board must designate two temporary interim successors.


                        FISCAL IMPACT


The proposed amendment does not result in any increase in 
expenditures from the general fund.
