1 AN ACT
2 RELATING TO RULES OF THE ROAD; AMENDING CHAPTER 6, TITLE 49, IDAHO CODE, BY
3 THE ADDITION OF A NEW SECTION 49-629, IDAHO CODE, TO DESCRIBE CERTAIN PRO-
4 HIBITIVE LANE MARKINGS AND THE LIMITATIONS THEY IMPOSE AND TO PROVIDE
5 EXCEPTIONS.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Chapter 6, Title 49, Idaho Code, be, and the same is
8 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
9 ignated as Section 49-629, Idaho Code, and to read as follows:
10 49-629. PROHIBITIVE LANE MARKINGS -- EXCEPTIONS. (1) When double yellow
11 solid lines are in place, no person driving a vehicle shall drive to the left
12 thereof, except as permitted in this section, section 49-630(1)(b) or section
13 49-635(3), Idaho Code.
14 (2) When the double yellow lines, one (1) of which is broken, are in
15 place, no person driving a vehicle shall drive to the left thereof, except:
16 (a) A driver on that side of the roadway in which the broken line is in
17 place may cross over the double line or drive to the left thereof when
18 overtaking or passing other vehicles;
19 (b) As provided in section 49-630(1)(b) or 49-644(3), Idaho Code.
20 (3) The provisions of subsections (1) or (2) of this section do not pro-
21 hibit a driver from crossing the marking when:
22 (a) Turning to the left at any intersection or into or out of an alley,
23 private road, driveway or roadway; or
24 (b) Making a U-turn under the rules governing that turn.
25 (4) Other prohibitive pavement markings may be used when placed in accor-
26 dance with standards established by the manual on uniform traffic control
27 devises for streets and highways as adopted by the Idaho transportation
28 department.

This bill will further clarify the legality of crossing double
parallel solid lines on our roadways.
