LOBBYISTS - Adds to existing law to require any person who has made
lobbying expenditures, which are not reported by a registered lobbyist and
which exceed $250 in the aggregate during any calendar quarter, shall be

  1                                        AN ACT
  2    RELATING TO LOBBYISTS; AMENDING CHAPTER 66, TITLE 67, IDAHO CODE, BY THE ADDI-
  3        TION OF A NEW SECTION 67-6617A, IDAHO CODE, TO REQUIRE THAT ANY PERSON WHO
  4        HAS MADE LOBBYING EXPENDITURES, NOT REPORTED  BY  A  REGISTERED  LOBBYIST,
  5        EXCEEDING  TWO  HUNDRED FIFTY DOLLARS IN THE AGGREGATE DURING ANY CALENDAR
  6        QUARTER SHALL BE REQUIRED TO REGISTER AS A LOBBYIST WITHIN SEVEN  DAYS  OF
  7        EXCEEDING  THE  TWO HUNDRED FIFTY DOLLAR THRESHOLD; AND DECLARING AN EMER-
  8        GENCY.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION 1.  That Chapter 66, Title 67, Idaho Code, be,  and  the  same  is
 11    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 12    ignated as Section 67-6617A, Idaho Code, and to read as follows:
                                                                        
 13        67-6617A.  PERSONS MAKING LOBBYING EXPENDITURES NOT REPORTED BY  A  REGIS-
 14    TERED  LOBBYIST.  Notwithstanding  the provisions of section 67-6618(c), Idaho
 15    Code, any person who has made lobbying expenditures, not reported by a  regis-
 16    tered  lobbyist pursuant to section 67-6619, Idaho Code, exceeding two hundred
 17    fifty dollars ($250) in the aggregate during any  calendar  quarter  shall  be
 18    required  to register as a lobbyist within seven (7) days of exceeding the two
 19    hundred fifty dollar ($250) threshold, pursuant to the provisions  of  section
 20    67-6617,  Idaho  Code. Such person shall file the expenditure reports required
 21    by section 67-6619, Idaho Code.
                                                                        
 22        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 23    declared to exist, this act shall be in full force and effect on and after its
 24    passage and approval.

Statement of Purpose / Fiscal Impact


                     STATEMENT OF PURPOSE
                           RS 11926

	The purpose of this legislation is to enhance disclosure 
under the Sunshine Law by providing that any person that expends 
over two hundred fifty dollars ($250) lobbying needs to register 
and report under the act. This requirement would be mandatory even 
though no person may be compensated as a lobbyist.



                   FISCAL IMPACT

The fiscal impact to the general fund of the State of Idaho would 
be minimal.
