  1                                        AN ACT
  2    RELATING TO ELECTRICAL CONTRACTORS AND JOURNEYMEN; AMENDING  SECTION  54-1002,
  3        IDAHO  CODE, TO CLARIFY THAT NO LOCAL JURISDICTION SHALL HAVE AUTHORITY TO
  4        REQUIRE A STATE LICENSEE TO PAY FEES TO THE LOCAL JURISDICTION IN ORDER TO
  5        ENGAGE IN THE ELECTRICAL CONSTRUCTION TRADE WITHIN  THAT  LOCAL  JURISDIC-
  6        TION.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Section 54-1002, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        54-1002.  LICENSE ESSENTIAL TO ENGAGE IN BUSINESS --  LICENSURE  AUTHORITY
 11    EXCLUSIVE  TO THE STATE. (1) It shall be unlawful for any person, partnership,
 12    company, firm, association or corporation, to act, or attempt to  act,  as  an
 13    electrical  contractor  or  special  electrical contractor in this state until
 14    such person, partnership, company, firm,  association  or  corporation,  shall
 15    have received a license as an electrical contractor, as herein defined, issued
 16    pursuant  to  the provisions of this chapter by the administrator of the divi-
 17    sion of building safety.
 18        (2)  It shall be unlawful for any person to act as a  journeyman  electri-
 19    cian  in this state until such person shall have received a license as a jour-
 20    neyman electrician, as herein defined, issued pursuant to  the  provisions  of
 21    this  act,  by the administrator of the division of building safety, provided,
 22    however, that any person who has been issued a  master  electrician's  license
 23    pursuant to this chapter may act as a journeyman electrician.
 24        (3)  It shall be unlawful for any person to act as a specialty electrician
 25    in  this  state until such person shall have received a license as a specialty
 26    electrician, as herein defined, issued pursuant to the provisions of this act,
 27    by the administrator of the division of  building  safety,  provided  however,
 28    that  any person who has been issued a master electrician's license or a jour-
 29    neyman electrician's license pursuant to this act may act as a specialty elec-
 30    trician.
 31        (4)  Licensure of electrical contractors, journeyman electricians,  master
 32    electricians,  specialty  electricians,  specialty  electrical contractors and
 33    registration of apprentice electricians shall be within the  exclusive  juris-
 34    diction  of the state pursuant to this chapter and no local jurisdiction shall
 35    have the authority to require additional licensure or to  require  payment  of
 36    any  fees  in  order for any licensee to engage in the electrical construction
 37    trade within the local jurisdiction or to issue licenses to  persons  licensed
 38    under  this chapter which are inconsistent with the provisions of this chapter
 39    or rules promulgated by the division  of  building  safety.  The  state  shall
 40    investigate  all  local  infractions  and state violations of this chapter and
 41    prosecute the same. The local jurisdictions will assist the state by  request-
 42    ing  investigations  within their jurisdictions. Nothing in this chapter shall
 43    restrict a city or county from imposing stricter public safety rules, notwith-

  1    standing any provision of Idaho Code.

Statement of Purpose / Fiscal Impact


                    STATEMENT OF PURPOSE
                         RS 12030

This legislation clarifies that only the State of Idaho, Building 
Safety Division, may issue electrical licenses. Currently some 
cities are requiring registration fees rather than license fees 
in order to circumvent the current legislation disallowing the 
issuance of an electrical license by other than the State.
