|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 707 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO REPORTS OF CONTRIBUTIONS AND EXPENDITURES IN ELECTIONS; AMENDING 3 SECTION 67-6607, IDAHO CODE, TO REVISE REPORTING DEADLINES FOR ALL POLITI- 4 CAL COMMITTEES SUPPORTING OR OPPOSING MEASURES, FOR A STATEMENT OF ALL 5 CONTRIBUTIONS RECEIVED AND ALL EXPENDITURES OR ENCUMBRANCES MADE BY OR ON 6 BEHALF OF THE MEASURE OR ANY CANDIDATE OR MADE BY OR AGAINST THE MEASURE 7 OR ANY CANDIDATE; AND DECLARING AN EMERGENCY. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 67-6607, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 67-6607. REPORTS OF CONTRIBUTIONS AND EXPENDITURES. (a) The political 12 treasurer for each candidate and the political treasurer of each political 13 committee shall file with the secretary of state: 14 (1) Not more than fourteen (14) days and not less than seven (7) days 15 before the date of a primary election in which the candidate or political 16 committee is involved, a statement of all contributions received and all 17 expenditures or encumbrances made by or on behalf of the candidate or 18 political committee prior to the fifteenth day before the primary elec- 19 tion; 20 (2) Not more than thirty (30) days after the date of a primary election 21 in which a candidate or a political committee is involved, a statement of 22 all contributions received and all expenditures or encumbrances made by or 23 on behalf of the candidate or political committee to cover the period 24 since the fifteenth day before the primary election to and including the 25 tenth day after the primary election; 26 (3) For all political committees supporting or opposing measures, a 27 statement of all contributions received and all expenditures or encum- 28 brances made by or on behalf of the measure or any candidate or made by or 29 against the measure or any candidate shall be filed onApril 30 and July3030 of each year to cover the period since the preceding report, if any,31has been filed. Such committees shall also file the statements required in32subsections (4), (5) and (6) of this section; provided, that the state-33ment required in subsection (4) shall cover the period from July 1 to and34including September 30the same dates provided in paragraphs (1), (2), 35 (4), (5) and (6) of this subsection; 36 (4) Not later than October 10 immediately preceding a general election in 37 which the candidate or political committee is involved, a statement of all 38 contributions received and all expenditures or encumbrances made by or on 39 behalf of the candidate or political committee since and including the 40 eleventh day after the date of the primary election and to and including 41 September 30; 42 (5) Not more than fourteen (14) days and not less than seven (7) days 43 before the date of a general election in which the candidate or political 2 1 committee is involved, a statement of all contributions received and all 2 expenditures or encumbrances made by or on behalf of the candidate or 3 political committee since and including October 1 and to and including the 4 sixteenth day before the general election, together with a cumulative 5 statement showing all such contributions and expenditures or encumbrances 6 to and including the sixteenth day before the general election; and 7 (6) Not more than thirty (30) days after the date of a general election 8 in which the candidate or political committee is involved, a statement of 9 all contributions received and all expenditures or encumbrances made by or 10 on behalf of the candidate or political committee to cover the period 11 since the fifteenth day before the general election to and including the 12 tenth day after the general election. 13 (b) For the first report under this section the reporting period shall 14 cover the period beginning with the first contribution, expenditure, or encum- 15 brance. 16 (c) Notwithstanding any other reports required under this section, the 17 political treasurer for each candidate and any political committee supporting 18 or opposing a measure shall notify the secretary of state, in writing, of any 19 contribution of one thousand dollars ($1,000) or more, received by the politi- 20 cal treasurer after the sixteenth day before, but more than forty-eight (48) 21 hours before, any primary or general election. This notification shall be made 22 within forty-eight (48) hours after the receipt of such contribution and shall 23 include the name of the candidate or measure, the identification of the con- 24 tributor, and the date of receipt and amount of the contribution. The notifi- 25 cation shall be in addition to the reporting of these contributions in the 26 post election report. 27 (d) For all reports required pursuant to this section the secretary of 28 state shall accept the date of a postmark as the date of receipt except for 29 the seven (7) day pre-election reports which must be received by no later than 30 5:00 p.m. on the seventh day preceding the primary or general election. 31 (e) Any reports required to be filed under the provisions of this section 32 may also be filed by means of an electronic facsimile transmission machine. 33 SECTION 2. An emergency existing therefor, which emergency is hereby 34 declared to exist, this act shall be in full force and effect on and after its 35 passage and approval.
STATEMENT OF PURPOSE RS 12175 The purpose of this legislation is to require political committees that are supporting or opposing measures to file campaign disclosure reports at the same time as candidates and other political committees. Two quarterly reports required currently would be replaced by a pre and post primary report. FISCAL IMPACT There is no fiscal impact to the State of Idaho.
