  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE  STATE  DEPARTMENT  OF
  3        WATER  RESOURCES,  THE  UNIVERSITY OF IDAHO, AND IDAHO STATE UNIVERSITY TO
  4        ENTER INTO AGREEMENTS WITH THE IDAHO STATE BUILDING AUTHORITY  TO  FINANCE
  5        THE CONSTRUCTION OF THE IDAHO WATER CENTER AND IDAHO PLACE PROJECTS.
                                                                        
  6    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  7        WHEREAS, the State Board of Education has directed Idaho's institutions of
  8    higher education to "collaborate in hosting programs and cooperate to meet the
  9    educational  needs of all Idahoans, including those who are at a distance from
 10    campus" (Statement of Outreach and Cooperation); and
 11        WHEREAS, in furtherance of the State Board  of  Education's  Statement  of
 12    Outreach  and  Cooperation, the University of Idaho and Idaho State University
 13    desire to create a collaborative, multidisciplinary office, research and  edu-
 14    cation  facility,  to be known as the "Idaho Place," to provide the residents,
 15    businesses and public agencies of the Treasure Valley access to University  of
 16    Idaho and Idaho State University programs and provide a unique opportunity for
 17    collaboration between government, business and higher education; and
 18        WHEREAS, the University of Idaho also has significant research and related
 19    activities  focused  on  water  and water quality that can be enhanced through
 20    partnership and collaboration with other public agencies and private  entities
 21    that focus on water and natural resources; and
 22        WHEREAS,  the  Idaho Department of Water Resources (IDWR) manages and pro-
 23    tects Idaho's surface and ground water resources, stream channels, and  water-
 24    sheds to ensure that water and energy are conserved and available for sustain-
 25    ing  Idaho's  economy  and  ecosystems,  and IDWR's activities can be enhanced
 26    through partnership and collaboration with the University of Idaho; and
 27        WHEREAS, the University of Idaho and IDWR desire to create, as a component
 28    of Idaho Place, a collaborative, multidisciplinary office, research and educa-
 29    tion facility to be known as the "Idaho Water Center,"  that  will  provide  a
 30    unique  opportunity  for collaboration between government, business and higher
 31    education entities that focus on water and natural resources; and
 32        WHEREAS, Section 67-5708A, Idaho Code, requires state agencies,  prior  to
 33    leasing  any  new facilities, to perform a comprehensive analysis to determine
 34    whether a suitable facility for the long-term needs  and  objectives  of  that
 35    agency  could  be  provided  at  the  lowest  responsible cost to the taxpayer
 36    through other means, including leasing-to-own  facilities  through  the  Idaho
 37    State Building Authority; and
 38        WHEREAS,  the  University  of  Idaho, Idaho State University and IDWR have
 39    determined that their long-term needs and objectives would be best  served  at
 40    the  lowest  responsible  cost  to  the  taxpayers if they leased-to-own their
 41    facilities at the Idaho Place and the Idaho Water  Center  through  the  Idaho
 42    State Building Authority; and
 43        WHEREAS, the Idaho Department of Administration conducted an evaluation of
 44    proposals  for  leases  for  facilities  for  use  by IDWR pursuant to Section

  1    67-5708A, Idaho Code, and also determined that it is in the best  interest  of
  2    the IDWR to locate in the Idaho Water Center; and
  3        WHEREAS,  it  is  in  the  best  interest of the state for the Idaho State
  4    Building Authority to provide the facilities to be known as the "Idaho  Place"
  5    and  the  "Idaho Water Center" for use by the University of Idaho, Idaho State
  6    University, IDWR, other public agencies, and  private  companies,  to  promote
  7    their educational, service and business needs.
  8        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
  9    sion of the Fifty-sixth Idaho Legislature, the House  of  Representatives  and
 10    the Senate concurring therein, that the Legislature hereby authorizes and pro-
 11    vides  approval  for the University of Idaho, Idaho State University and IDWR,
 12    to enter into an agreement or agreements, either separately or together,  with
 13    the  Idaho State Building Authority, under such terms and conditions as may be
 14    reasonable and necessary, to provide for  the  financing  and  development  of
 15    office,  research and educational facilities, and related facilities, at Idaho
 16    Place and the Idaho Water Center in Boise, Idaho, for their uses and the  uses
 17    of  other public and/or private entities which may have affiliated, related or
 18    collaborative purposes.
 19        BE IT FURTHER RESOLVED that this resolution shall constitute the  approval
 20    under  Section  33-3805A,  Idaho  Code,  for the University of Idaho and Idaho
 21    State University to use General Account appropriated funds  for  construction,
 22    operation, and maintenance of the facilities being authorized hereby.
 23        BE  IT  FURTHER  RESOLVED  that  this resolution constitutes authorization
 24    required by the provisions of Section 67-6410, Idaho Code.

Statement of Purpose / Fiscal Impact


                                
                      STATEMENT OF PURPOSE
                                               
                                   
  This concurrent resolution authorizes the University of Idaho and 
Idaho State University (the "Universities") to enter into agreements 
with the Idaho State Building Authority to finance construction and 
acquisition of the Idaho Place, which will house programs of both
Universities, shared services for the Universities (auditorium and 
various-sized conference rooms) and facilities for retail business 
use (located along the active streets and plaza edges). The retail 
will be operated for the benefit of the University of Idaho and 
Idaho State University.  Idaho Place will be located near the Idaho 
Water Center on an approximate 6-acre parcel in Boise, Idaho 
(bordered by Front Street on the north, Myrtle Street on the
south, Broadway Avenue on the east, and South Avenue B on the west). 
Idaho Place will be developed in multiple phases in collaboration 
with government and private entities, and is envisioned to include 
several buildings of varying shapes, size and height.  Public paths
and open spaces will build on existing downtown and neighborhood 
networks and strengthen connections to the Ada County Courthouse 
development, Julia Davis Park, the Boise River Greenbelt and 
downtown Boise.
    
This concurrent resolution also authorizes IDWR and the University 
of Idaho to enter into agreements with the Idaho State Building 
Authority to finance construction and acquisition of the Idaho Water 
Center, which will be comprised of the main office for IDWR, 
facilities for water-related and research activities of the 
University of Idaho, other related state agencies, federal agencies 
and private tenants.  The Idaho Water Center will be located on
approximately two acres in the Ada County Courthouse Corridor 
Development in Boise, Idaho.
                                 
                          FISCAL NOTE
                                   
IDAHO PLACE:  There will be no fiscal impact in FY 2003.  The first 
lease payment would be due during FY 2004 or FY 2005.  The initial 
facilities are estimated to be completed and ready for occupancy in 
the Fourth Quarter of CY 2003.  Financing the development of the
Idaho Place through the Idaho State Building Authority provides the 
opportunity for the Universities to lease the facilities at 
favorable lease rates and to own, or lease at nominal charge, the 
facilities when the financing is paid in full.  Lease payments to 
the Idaho State Building Authority would come from a combination of 
rental revenues from other tenants and the Universities' general 
fund budgets and other appropriated funds.  The estimated gross 
building size required for the Universities (including shared 
institutional space) is approximately 275,000 square feet, 
including approximately 9,700 square feet for retail business use, 
plus approximately 158,000 square feet for parking.  The size of 
the new facilities will be determined based upon the number and 
space requirements of its occupants as identified.  Based on an 
estimated project cost of $88,000,000 the annual debt service for
a 40-year bond would be approximately $6,148,000.  The annual debt 
service obligations of the primary tenants will be reduced by 
revenue generated from other equity partners/tenants, interim 
subtenants (such as other agencies and interim users), public/private
partner retail tenants, university programs, research grants and 
contract activities, contributed funds and parking revenues.
      
IDAHO WATER CENTER:  There will be no fiscal impact in FY 2003.  The 
first lease payment would be due during FY 2004 (which begins on 
July 1, 2003).  The initial facilities are estimated to be completed 
and ready for occupancy in Second Quarter of CY 2003.  Financing 
the development of the Idaho Water Center through the Idaho State 
Building Authority provides the opportunity for IDWR and the 
University of Idaho to lease the facilities at favorable lease rates 
and to own, or lease at nominal charge, the facilities when
the financing is paid in full.  Lease payments to the Idaho State 
Building Authority would come from a combination of rental revenues 
from other tenants and from the general fund budgets and other 
appropriated funds of IDWR and the University of Idaho. The 
estimated net rentable square footage required for IDWR is 
approximately 50,000 square feet.  The size of the new facilities 
will be determined based upon the number and space requirements
of all suitable occupants that may be identified.  Based on an 
estimated project cost of $48,000,000, the annual debt service for 
a 30-year bond would be approximately $3,439,000.  The annual debt 
service obligations of the primary tenants will be reduced by revenue 
generated from other equity partners/tenants, interim subtenants 
(such as other agencies and interim users), public/private partner 
retail tenants, university programs, research grants and contract 
activities, and contributed funds.
